A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City  Center on the 22nd day of January, 2007, at 5:30 p.m.

Notice of the meeting was posted at the Bondurant City Center, Casey’s General Stores, Legacy Bank and the United States Post Office on January 19, 2007.  All proceedings hereafter shown were taken while the convened meeting was open to the public.

 

Mayor Pro Tem Michele Bailey  called the meeting to order at 5:40 p.m.  Roll call  was  taken and  a quorum was declared.

 

City Administrator Arentsen asked that item #8 be deleted from the agenda.  Motion made by Council Member Cordes, seconded by Council Member Adams, to approve the agenda, as amended.  Roll Call:  Cordes-Yes, Adams-, Bailey-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Adams, to approve the consent items consisting of the City Council Minutes of January 08, and January 18, 2007, Library Board of Trustees Minutes of December 07, 2006 and January 04, 2007, the Claims Report and Tax Abatement Applications for Adam Markham, 606 Mulberry Drive, Northwest; Dan and Karen Berggren, 1204 Cove Street, Southeast; Phillip and Patty Abels, 300 Mulberry Drive, Northwest; and Marjorie Trembly, 1400 Adams Street, Southeast, Bondurant, Polk County, Iowa.  Roll Call:  Cordes-Yes, Adams-Yes, Bailey-Yes.  Motion carried.

 

Council Member Kromrie arrived at 5:42 p.m.

 

Polk County Sheriff’s Department representative Lt. Peterman had nothing to report.

  

Mr. Randy York, The York Companies, 28187 Prospect Avenue, Adel, Iowa, presented a potential commercial project for Stoner Development and answered questions from Council.

 

Council Member Cordes requested that the following objectives be added to the City’s Mission Statement and not necessarily verbatim:  public safety services; recreational facilities and activities; provide planned organized growth and economical, feasible, commercial growth.  Motion made by Council Member Cordes, seconded by Council Member Adams, to approve Resolution No. 07-16, a Resolution approving the Mission Statement for the City of Bondurant, Polk County, Iowa, as amended.  Roll Call:  Cordes-Yes, Adams-Yes, Kromrie-Yes, Bailey-Yes.  Motion carried.

 

Mr. Richard Atterbury, CPA, Martens & Company, 4949 Pleasant Street, Suite 104, West Des Moines, Iowa, presented the audit proposal and answered questions from Council.  Motion made by Council Member Adams, seconded by Council Member Cordes, to approve Resolution No. 07-17, a Resolution approving the audit proposal submitted by Martens & Company, CPA, LLP.  Roll Call:  Adams-Yes, Cordes-Yes, Bailey-Yes, Kromrie-Yes.  Motion carried.

 

Mr. Skip Conkling, Bondurant Representative to the Des Moines Area Regional Transit (DART) presented an update on weekly bus service and answered questions from Council.  Motion made by Council Member Bailey, seconded by Council Member Cordes, to approve Resolution No. 07-18, a Resolution approving implementing public transit service provided by the Des Moines Area Regional Transit Authority (DART) for the City of Bondurant, Polk County, Iowa.  Roll:  Bailey-Yes, Cordes-Yes, Kromrie-Yes, Adams-Yes.  Motion carried.

 

Motion made by Council Member Kromrie, seconded by Council Member Adams, to approve Resolution No. 07-19, a Resolution approving the appointment of Bruce Cordes as the Primary Representative and Mark Arentsen as the Alternate Representative to the Metro Waste Authority Board for calendar year 2007.  Roll Call:  Kromrie-Yes, Adams-Yes, Bailey-Yes, Cordes-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Adams, to approve Resolution No. 07-20, a Resolution establishing the second meeting date in February as Tuesday, February 20, 2007, at 6:00 p.m., due to President’s Day.  Roll Call:  Cordes-Yes, Adams-Yes, Bailey-Yes, Kromrie-Yes.  Motion carried.

 

Motion made by Council Member Adams, seconded by Council Member Cordes, to approve Resolution No. 07-21, a Resolution establishing a Public Hearing date for February 05, 2007, at 6:00 p.m., in the Community Room at the Bondurant City Center, to consider amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by amending provisions pertaining to the adoption of the 2006 International Building Code, 2006 International Residential Code and the 2006 International Existing Building Code – Chapter 155.  Roll Call:  Adams-Yes, Cordes-Yes, Kromrie-Yes, Bailey-Yes.  Motion carried.

 

Motion made by Council Member Adams, seconded by Council Member Kromrie, to approve Resolution No. 07-22, a Resolution establishing a Public Hearing date for February 05, 2007, at

 

6:00 p.m., in the Community Room at the Bondurant City Center, to consider amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by amending provisions pertaining to the adoption of the 2006 International Mechanical Code and the 2006 International Fuel Gas Code – Chapter 156.  Roll Call:  Adams-Yes, Kromrie-Yes, Bailey-Yes, Cordes-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Kromrie, to approve Resolution No. 07-23, a Resolution establishing a Public Hearing date for February 05, 2007, at 6:00 p.m., in the Community Room at the Bondurant City Center, to consider amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by amending provisions pertaining to the adoption of the 2006 International Plumbing Code – Chapter 157.  Roll Call:  Cordes-Yes, Kromrie-Yes, Adams-Yes, Bailey-Yes.  Motion carried.  

 

Motion made by Council Member Adams, seconded by Council Member Kromrie, to approve Resolution No. 07-24, a Resolution establishing a Public Hearing date for February 05, 2007, at 6:00 p.m., in the Community Room at the Bondurant City Center, to consider amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by amending provisions pertaining to the adoption of the 2005 National Electrical Code – Chapter 158.  Roll Call:  Adams-Yes, Kromrie-Yes, Bailey-Yes, Cordes-Yes.  Motion carried.

Motion made by Council Member Cordes, seconded by Council Member Adams, to approve Resolution No. 07-28, a Resolution establishing a Public Hearing date for February 05, 2007, at 6:00 p.m., in the Community Room at the Bondurant City Center, to consider amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by repealing Chapter 159, pertaining

 

to the adoption of the 2002 National Electrical Code.  Roll Call:  Cordes-Yes, Adams-Yes, Bailey-Yes, Kromrie-Yes.  Motion carried. 

 

Motion made by Council Member Adams, seconded by Council Member Cordes, to approve Resolution No. 07-29, a Resolution establishing a Public Hearing date for February 05, 2007, at 6:00 p.m., in the Community Room at the Bondurant City Center, to consider amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by repealing Chapter 162, pertaining to the adoption of the 1997 Uniform Code for the Abatement of Dangerous Buildings.  Roll Call:  Adams-Yes, Cordes-Yes, Bailey-Yes, Kromrie-Yes.  Motion carried.

 

Motion made by Council Member Kromrie, seconded by Council Member Adams, to approve Resolution No. 07-30, a Resolution establishing a Public Hearing date for February 05, 2007, at 6:00 p.m., in the Community Room at the Bondurant City Center, to consider amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by repealing Chapter 163, pertaining to the adoption of the 1997 Life Safety Code.  Roll Call:  Kromrie-Yes, Adams-Yes, Bailey-Yes, Cordes-Yes.  Motion carried.  

 

Motion made by Council Member Kromrie, seconded by Council Member Cordes, to approve Resolution No. 07-31, a Resolution establishing a Public Hearing date for February 05, 2007, at 6:00 p.m., in the Community Room at the Bondurant City Center, to consider amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by repealing Chapter 166, pertaining to the adoption of the 2000 International Residential Code.  Roll Call:  Kromrie-Yes, Cordes-Yes, Bailey-Yes, Adams-Yes.  Motion carried.

 

City Administrator Arentsen led a discussion concerning FY 2007 budget meeting dates, establishing a three-way stop intersection at Mallard Pointe Drive, Northwest and 2nd Street, Northwest and replacing the computer and phone systems.

 

The following item(s) were discussed as part of City Administrator Arentsen’s comments:

 

v     Annexation update.

v     Negotiating a lease with Dr. Pick.

v     Farmer’s Cooperative land exchange update.

v     Special Council Meetings on January 29, and February 01, at 6:00 p.m.

v     Newsletter article deadline is February 01.

 

The following item(s) were discussed as part of Council Member’s comments:

 

q       Council Member Kromrie – Law enforcement options and distributed a floor plan for the new Public Safety building to Council.

q       Council Member Bailey – Snow ordinance is not being observed and certain residents are pushing snow from their property onto public streets.

q       Council Member Adams – No Comment.

q       Council Member Cordes – Requested WRA update; inquired about February 01, railroad meeting and questioned the validity of park land dedication.

Motion made by Council Member Kromrie, seconded by Council Member Cordes, to go into closed session, pursuant to Iowa Code Section 21.5c to discuss potential litigation with legal counsel.  Roll Call:  Kromrie-Yes, Cordes-Yes, Bailey-Yes, Adams-Yes.  Motion carried.  Council went into closed session at 7:28 p.m.
