PLANNING AND ZONING COMMISSION

MINUTES

 

 

A regular meeting of the City of Bondurant Planning & Zoning Commission was held in the Community Room at the Bondurant City Center on August 24, 2006, at 7:00 p.m.

Notice of the meeting was posted at the Bondurant City Center, Casey’s General Stores, Legacy Bank and the Bondurant Post Office on August 21, 2006. All proceedings hereafter shown were taken while the convened meeting was open to the public.

 

Commission Chair Skinner called the meeting to order at 7:04 p.m.  Roll call was taken and a quorum was declared.  Motion made by Commission Member Higgins, seconded by Commission Member Baker, to approve the agenda.  Roll call:  Ayes: 4.  Nays: 0.  Motion carried.

 

Motion made by Commission Member Higgins, seconded by Commission Member Baker to approve the Planning and Zoning Commission minutes of July 27, 2006.  Roll Call:  Ayes:  4.  Nays:  0.  Motion carried.

 

Motion made by Commission Member Baker, seconded by Commission Member Mark to approve the Planning and Zoning Commission minutes of August 10, 2006.  Roll Call:  Ayes:  4.  Nays:  0.  Motion carried.

 

Commission Chair Skinner led a discussion concerning proposed Ordinance No. 06-204, relating to Architectural Standards.

 

Commission Member Higgins suggested that Members should start on page one and proceed through each section.

Commission Members Mark and Baker expressed their concern on exhausting too much time on this ordinance and then have the City Council waive or modify the requirements to the point the ordinance would lose it’s intent.

 

Commission Members Higgins and Mark stated their concern that the 30% hard surface requirements for multi-dwellings may be too restrictive, as stated in Section 1.2.                                                 Commission Member Higgins said that this ordinance should be like the City of Grimes where the windows and doors would be included on the 30% hard surface requirements.  After considerable discussion, the Commission decided to keep this section as written.

 

In section 1.b., the Commission elected to require existing townhouses and multi-family structures to meet the Architecture Standards, if the structure is undergoing a rehabilitation of 60% or more.

 

The Commission left the remainder of Section 1.2 as written.

 

Commission Member Higgins questioned if 50% of hard surface would be too excessive for any “C” District, especially when the ordinance calls for hard surfacing on all four sides of the structure, when all four sides will not be in the public view.  This comment from Commission Member Higgins brought up another question from members on what is classified as “in the public view”.  After considerable debate, the Commission felt it would be best to discuss sections 1.3, 1.4, and 1.5 in more depth at the next meeting.

 

Commission member Skinner expressed his concerns on Section 1.6 that states that all lots on Highway 65 must be set back at least 600 feet from the corridor. After input from the Commission Members, they felt this section should be tabled until the next meeting.

 

The Commission Members discussed Section 1.7 and have significant concerns about the council being able to override the Architectural Standards.  A consensus was reached by all Commission Members, where possibly the City Council Members and the Planning/Zoning Members could meet and vote simultaneously when City Council Members do not agree with the P&Z recommendation(s). Commission Member Skinner asked City Administrator Arentsen if he could contact City Attorney Matt Brick if the P&Z Members could vote with the City  Council on this issue since the P&Z Members are not elected officials.
