A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City Center on the 03rd day of March, 2008, at 6:00 p.m.

Absent:                None

 

Notice of the meeting was posted at the Bondurant City Center, Casey’s General Stores, Legacy Bank and the United States Post Office on February 29, 2008.  All proceedings hereafter shown were taken while the convened meeting was open to the public.

 

Mayor Pro Tem Adams called the meeting to order at 6:05 p.m.  Roll call was taken and  a quorum was declared.

 

Motion made by Council Member Bailey, seconded by Council Member Ryan, to approve the agenda, as presented.  Roll Call:  Bailey-Yes, Ryan-Yes, Boatwright-Yes, Sullivan-Yes, Adams-Yes.  Motion carried.

 

Mayor McCoid presided over the meeting at 6:07 p.m.

 

Motion made by Council Member Bailey, seconded by Council Member Adams, to approve the consent items consisting of the City Council Minutes of February 19, 2008, Planning and Zoning Commission Minutes of February 07, 2008, the Claims Report and Tax Abatement Applications for Beth Hick, 3413 Maple Drive, Southwest; Justin Pals, 1200 – 15th Street, Southeast; Michael & Nicole Webb, 3304 Maple Drive, Southwest; and Kent Klingbeil & Shelley Allen, 607 Mulberry Drive, Northwest, Bondurant, Polk County, Iowa. Roll Call:  Bailey-Yes, Adams-Yes, Ryan-Yes, Boatwright-Yes, Sullivan-Yes.  Motion carried. 

 

Polk County Sheriff’s Department representative Deputy Arcuri had nothing to report.

 

Motion made by Council Member Bailey, seconded by Council Member Ryan, to close the regular City Council meeting at 6:10 p.m., and open the Public Hearing for consideration of approving the Municipal Budget for Fiscal Year 2008 / 2009 for the City of Bondurant, Polk County, Iowa.  Roll Call:  Bailey-Yes, Ryan-Yes, Adams-Yes, Sullivan-Yes, Boatwright-Yes.  Motion carried.  No verbal comments were received during the Public Hearing.  Motion made by Council Member Ryan, seconded by Council Member Boatwright, to close the Public Hearing at 6:11 p.m., and open the regular City Council meeting.  Roll Call:  Ryan-Yes, Boatwright-Yes, Adams-Yes, Bailey-Yes, Sullivan-Yes.  Motion carried.  Motion made by Council Member Bailey, seconded by Council Member Ryan, to approve Resolution No. 08-38, a Resolution approving the Municipal Budget for the City of Bondurant, Polk County, Iowa, for Fiscal Year 2008 / 2009.  Roll Call:  Bailey-Yes, Ryan-Yes, Sullivan-Yes, Boatwright, Adams-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Ryan, to approve the second reading of Ordinance No 08-203, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, Chapter 99, Section 99.02, pertaining to Rates for Sanitary Sewer Service, effective July 01, 2008.  The increase would be 0 to 1300 gallons at a minimum of $6.13.  All consumption over 1300 gallons would be $6.63 per 1,000 gallons.  Roll Call:  Bailey-Yes, Ryan-Yes, Adams-Yes, Boatwright-Yes, Sullivan-Yes.  Motion carried.

 

Motion made by Council Member Ryan, seconded by Council Member Bailey, to approve the second reading of Ordinance No. 08-204, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, Chapter 15, Section 15.04, pertaining to Mayor Compensation.  The proposed salary for the Mayor is sixty-two hundred dollars ($6,200.00) per year, payable annually and would become effective no earlier than January 01, 2010.  Roll Call:  Ryan-Yes, Bailey-Yes, Adams-Yes, Boatwright-No, Sullivan-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Boatwright, to approve the second reading of Ordinance No. 08-205, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by amending Chapter 17, Section 17.06, pertaining to Council Member Compensation.  The proposed salary of each Council Member is one hundred forty-five dollars and eighty-four cents ($145.84) for each regular and special meeting of the Council attended, payable annually and will not become effective during the Council Member’s term in which the change is adopted.  Roll Call:  Bailey-Yes, Boatwright-No, Ryan-Yes, Sullivan-No, Adams-No.  Motion failed. 

 

Mayor McCoid asked Mayor Pro Tem Adams to preside over the meeting at 6:13 p.m., citing a conflict of interest.  Motion made by Council Member Ryan, seconded by Council Member Bailey, to approve the second reading of Ordinance No. 08-206, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, Chapter 37, Section 37.05, pertaining to False Alarm Service Charges.  Roll Call:  Ryan-Yes, Bailey-Yes, Adams-Yes, Sullivan-Yes, Boatwright-Yes.  Motion carried.

  

Motion made by Council Member Ryan, seconded by Council Member Bailey, expressing support for studying the Improvement of Emergency Management Services Delivery for Eastern Polk County.  Roll Call:  Ryan-Yes, Bailey-Yes, Adams-Yes, Sullivan-Yes, Boatwright-Yes.  Motion carried.

 

Motion made by Council Member Adams, seconded by Council Member Ryan, to approve Resolution No. 08-39, a Resolution approving the participation of the City of Bondurant, Polk County, Iowa, in the Northeast Polk County Coalition.  Roll Call:  Adams-Yes, Ryan-Yes, Bailey-Yes, Boatwright-Yes, Sullivan-Yes.  Motion carried.

 

City Attorney Brick led a discussion pertaining to a tobacco violation issued against Mobil Food Mart, 1111 Lincoln Street, Southeast, Bondurant, Polk County, Iowa.

·            Council Members Adams – Thanked the Mayor for her involvement in the Disabled Veterans benefit.

·            Bailey – No Comment.

·            Council Member Ryan – Asked about future street repairs.

·            Council Member Boatwright – Snow complaints and Franklin Street, Southwest, street sign.

·            Council Member Sullivan – No Comment.

 

The following item(s) were discussed as part of City Attorney Brick’s comments:

 

·            Complimented City Staff for keeping the City’s Municipal Code Book up to date.
