A regular meeting of
the City Council of the City of Bondurant, Polk County, Iowa, was held in the
Community Room at the Bondurant City Center on the 07th day of January, 2008,
at 6:00 p.m.

Notice of the meeting was posted at the
Bondurant City Center, Casey’s General Stores, Legacy Bank and the United
States Post Office on January 04, 2008.
All proceedings hereafter shown were taken while the convened meeting
was open to the public.
Mayor McCoid called the meeting to order at
6:00 p.m. Roll call was taken and a quorum was
declared.
Motion made by Council Member Adams,
seconded by Council Member Ryan, to approve the agenda as presented. Roll Call:
Adams-Yes, Ryan-Yes, Bailey-Yes, Boatwright-Yes, Sullivan-Yes. Motion carried.
Motion made by Council Member Adams, seconded by Council Member Ryan, to
approve the consent items consisting of the City Council Minutes of December 17,
2007, the Claims Report and Tax Abatement applications for Spencer Blunt, 413 –
4th Street, Northwest; Dena Williams, 809 – 13th Street, Southeast; John F.
Shea, 3306 Ash Drive, Southwest; Joseph Hetzer, 820 – 35th Street, Southwest;
Todd Michael Tegeler, 610 Mulberry Drive, Northwest; Andrea Gach, 3316 Maple
Drive, Southwest; Greg T. Schlaefle, 900 – 35th Street, Southwest; and Brian
Allen Heim, 804, 35th Street, Southwest, Bondurant, Polk County, Iowa. Roll Call:
Adams-Yes, Ryan-Yes, Bailey-Yes, Boatwright-Yes, Sullivan-Yes. Motion carried.
Polk County Sheriff’s Department representative was not present.
Mayor McCoid presented “Oath of Office” certificates to Council Member Mike Adams, Sr., and Council Members-Elect Eric Boatwright and Curt Sullivan.
Motion made by Council Member Bailey, seconded by Council Member Ryan, to close the regular City Council meeting at 6:05 p.m., and open the Public Hearing for consideration of various voluntary annexation applications to the City of Bondurant, Polk County, Iowa. Roll Call: Bailey-Yes, Ryan-Yes, Adams-Yes, Boatwright-Yes, Sullivan-Yes. No verbal comments were received during the Public Hearing. Motion made by Council Member Bailey, seconded by Council Member Boatwright, to close the Public Hearing at 6:06 p.m., and open the regular City Council meeting. Roll Call: Bailey-Yes, Boatwright-Yes, Adams-Yes, Sullivan-Yes, Ryan-Yes. Motion carried. Motion made by Council Member Bailey, seconded by Council Member Ryan, to approve Resolution No. 08-01, a Resolution approving the various voluntary annexation applications to the City of Bondurant, Polk County, Iowa. Mr. Vic Piagentini, Associated Engineering
Company of Iowa, 2917 Martin Luther King, Jr., Parkway, Des Moines, Iowa, presented
the Final Plat for Efnor Estates Plat 1 and answered questions from the Mayor
and Council. Motion made by Council
Member Boatwright, seconded by Council Member Ryan, to approve Resolution No.
08-02, a Resolution approving the Final Plat for Efnor Estates Plat 1, subject
to Marshall Drive, Northwest, being re-named Mallard Pointe Drive, Northwest;
Griffin Parkway, Northwest, being re-named 1st Street, Northwest; and the City
Engineer confirming that the addresses conform to the City’s addressing system. Roll Call:
Boatwright-Yes, Ryan-Yes, Adams-Yes, Bailey-Yes, Sullivan-Yes. Motion carried.
Mr. David Klockau, Environmental Reclamation
& Recycling, Inc. (ERR), 1422 Scott Avenue, Des Moines, Iowa, presented no
solution to the material deposited at 3507 Grant Street, South, Bondurant,
Iowa, but thanked the Mayor and Council for their patience.
Motion made by Council Member Adams, seconded
by Council Member Bailey, to approve the third and final reading of Ordinance
No. 07-220, an Ordinance amending the Code of Ordinances of the City of
Bondurant, Iowa, 2002, Chapter 69, Section 69.12, by amending provisions
pertaining to “Parking Where Prohibited” within the City of Bondurant, Polk
County, Iowa. Roll Call: Adams-Yes, Bailey-Yes, Ryan-Yes,
Boatwright-Yes, Sullivan-Yes. Motion
carried.
Motion made by Council Member Bailey,
seconded by Council Member Adams, to waive the first and second reading of
Ordinance No. 08-200, an Ordinance amending the Code of Ordinances of the City
of Bondurant, Iowa, 2002, Chapter 69, Section 69.09, by amending provisions
pertaining to “Truck Parking Limitations” and approve as the third and final
reading. Roll Call: Bailey-Yes, Adams-Yes, Ryan-Yes,
Boatwright-Yes, Sullivan-Yes. Motion
carried.
Motion made by Council Member Bailey,
seconded by Council Member Adams, to waive the first and second reading of
Ordinance No. 08-201, an Ordinance amending the Code of Ordinances of the City
of Bondurant, Iowa, 2002, Chapter 69, Section 69.10, by amending provisions
pertaining to “Snow Removal” and approve as the third and final reading. The Ordinance states that the City of
Bondurant Snow Ordinance shall take effect following a
declaration of same by the City Administrator or Street Superintendent. Vehicles must be removed from any City street by 8:00 p.m., and must remain off of the City street until 8:00
a.m., the following day or until the snow declaration has
been lifted, whichever occurs latest. Vehicles not removed by 8:00 p.m., will
be ticketed for violating the City’s Snow Ordinance. After being ticketed,
vehicles not removed from the City street by 8:00
a.m., the following day will be towed, with expenses for towing payable by the

Member Boatwright, to waive the first and second reading of Ordinance No. 08-202, an Ordinance
amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, Chapter
136, Section 136.03, by amending provisions pertaining to “Removal of Snow, Ice
and Accumulations on Sidewalks” and approve as the third and final
reading. Roll Call: Bailey-Yes, Boatwright-Yes, Adams-Yes,
Ryan-Yes, Sullivan-Yes. Motion carried.

seconded by Council Member Adams, to approve Resolution No. 08-03, a Resolution
designating the Herald-Index, Des Moines Register and Press Citizen, as the
official newspapers of record for the City of Bondurant, Polk County, Iowa, for
calendar year 2008. Roll Call: Bailey-Yes, Adams-Yes, Ryan-Yes,
Boatwright-Yes, Sullivan-Yes. Motion

seconded by Council Member Bailey, to approve Resolution No. 08-04, a
Resolution approving Legacy Bank, Bondurant National Bank, IPAIT, Wells Fargo
Bank and U. S. Bank as the official depositories for the City of Bondurant,
Polk County, Iowa. Roll Call: Boatwright-Yes, Bailey-Yes, Adams-Yes,
Ryan-Yes, Sullivan-Yes. Motion carried.
Motion made by Council Member Bailey,
seconded by Council Member Adams, to approve Resolution No. 08-05, a Resolution
approving the appointment of Roy McCleary, 900 Grant Street, South, Bondurant,
Iowa, to the City of Bondurant Planning and Zoning Commission seat vacated by
Curt Sullivan, effective January 01, 2008, through December 31, 2009. Roll Call:
Bailey-Yes, Adams-Yes, Ryan-Yes, Boatwright-Yes, Sullivan-Yes. Motion carried.

by Council Member Bailey, to approve Resolution No. 08-06, a Resolution
approving the revised City of Bondurant Investment Policy Section VI(3), for

Necessity pertaining to the stop box replacement at 9493 Northeast Timber Creek
Drive, Bondurant, Polk County, Iowa.

Motion made by Council Member Boatwright, seconded by Council Member Bailey, to approve Resolution No. 08-08, a Resolution approving the appointment of Marlene Valentine, 301 – 2nd Street, Northwest, Bondurant, Iowa, to represent the City of Bondurant on the Northeast Beltway Citizens Advisory Committee for calendar year 2008. Roll Call: Boatwright-Yes, Bailey- Yes, Adams-Yes, Ryan-Yes, Sullivan-Yes. Motion carried.

on the Post Office lease; forgiveness and reimbursement for snow ordinance
