A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City Center on the 05th day of November, 2007, at 6:00 p.m.

Notice of the meeting was posted at the Bondurant City Center, Casey’s General Stores, Legacy Bank and the United States Post Office on November 01, 2007.  All proceedings hereafter shown were taken while the convened meeting was open to the public.

 

Mayor McCoid called the meeting to order at 6:00 p.m.  Roll call was taken and  a quorum was declared.

 

Motion made by Council Member Cordes, seconded by Council Member Bailey, to approve the agenda as presented.  Roll Call:  Cordes-Yes, Bailey-Yes, Kromrie-Yes, Ryan-Yes, Adams-Yes.  Motion carried. 

 

Motion made by Council Member Bailey, seconded by Council Member Adams, to approve the consent items consisting of the City Council Minutes of October 15, and October 17, 2007,  the Claims Report and Tax Abatement Application for Chris Carl, 3416 Maple Drive, Southwest; Derek & Dianne Griffith, 606 Evergreen Circle, Northwest; Ryan Atchison, 800 – 35th Street, Southwest; Robert & Patricia Helstern, 1012 – 14th Street, Southeast; Amy Sharp, 302 Mulberry Drive, Northwest; Ryan Sanderson, 310 Walnut Drive, Northwest; Daniel D. Polk County Sheriff’s Department representative Lt. Peterman was present and had nothing to report.

  

Motion made by Council Member Adams, seconded by Council Member Cordes, to approve Resolution No. 07-153, a Resolution approving the transfer of $12,984.00 from the Capital Projects Fund to the General Fund for City sidewalk repairs around City Park on Lincoln Street and 3rd Street, Southeast and the construction of new sidewalks over City waterway connecting 703 Lincoln Street, Southeast and 901 Lincoln Street, Southeast.  Roll Call:  Adams-Yes, Cordes-Yes, Bailey-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Adams, to approve Resolution No. 07-154, a Resolution approving the State of Iowa Financial Report for Fiscal Year 2007.  Roll Call:  Bailey-Yes, Adams-Yes, Ryan-Yes, Cordes-Yes, Kromrie-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Adams, to approve Resolution No. 07-155, a Resolution approving the private contribution from Environmental Reclamation and Recycling, Inc., 1422 Scott Avenue, Des Moines, Iowa, (concerning the property at 3507 Grant Street, South, Bondurant, Polk County, Iowa), in the amount of $1,500.00 per month, be allocated as the following:  50% to the Bondurant Community Library project and 50% to the Bondurant Public Safety Building project.  Roll Call:  Bailey-Yes, Adams-Yes, Kromrie-No, Cordes-Yes, Ryan-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Ryan, to approve Resolution No. 07-156, a Resolution approving the Agreement for Cooperative Public Service between the City of Bondurant, Iowa, and Polk County, Iowa, pertaining to annual road maintenance.  Roll Call:  Bailey-Yes, Ryan-Yes, Cordes-Yes, Adams-Yes, Kromrie-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Bailey, to approve Resolution No. 07-157, a Resolution approving the renewal License for Class C Beer and Sunday Sales permit application for Casey’s Marketing Company, d/b/a Casey’s General Store #1373, a Privately Held Corporation, 302 – 2nd Street, Northeast, Bondurant, Polk County, Iowa.  Roll Call:  Cordes-Yes, Bailey-Yes, Adams-Yes, Ryan-Yes, Kromrie-Abstain.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Ryan, to approve Resolution No. 07-158, a Resolution approving the renewal License for Special Class C Liquor, Beer or Wine and Sunday Sales permit application for Polito’s Pizza House, Inc., d/b/a Polito’s Pizza House, Inc., a Privately Held Corporation, 210 Lincoln Street, Northeast, Bondurant, Polk County, Iowa.  Roll Call:  Bailey-Yes, Ryan-Yes, Cordes-Yes, Adams-Yes, Kromrie-Yes.  Motion carried.

 

Mayor McCoid asked Mayor Pro Tem Bailey to preside over the meeting for the next agenda item.

  

Motion made by Council Member Ryan, seconded by Council Member Adams, to approve Resolution No. 07-159, a Resolution approving the new Class C Liquor License (LC) Commercial, Outdoor Service and Sunday Sales permit application for Hamm Family, LLC, d/b/a Cory’s Irish Pub, a Limited Liability Company, 110 – 1st Street, Southeast, Bondurant, Polk County, Iowa.  Roll Call:  Ryan-Yes, Adams-Yes, Cordes-Yes, Kromrie-Yes, Bailey-Yes.  Motion carried.

 

Mayor McCoid presided over the remainder of the meeting.

 

Motion made by Council Member Bailey, seconded by Council Member Adams, to approve Resolution No. 07-160, a Resolution approving the appointment of Council Member Keith Ryan, 508 – 15th Street, Southeast, Bondurant, Polk County, Iowa, to represent the City of Bondurant on the Metro Waste Authority Board, effective November 05, 2007.  Roll Call:  Bailey-Yes, Adams-Yes, Cordes-Yes, Ryan-Yes, Kromrie-Yes.  Motion carried.

 

Mr. David Harrison, Design Alliance, presented the bid submitted by Huber Grading, 302 – 2nd Street, Northeast, Bondurant, Iowa, for the Public Safety Building Site Work.  Motion made by Council Member Kromrie, seconded by Council Member Cordes, to table Resolution No. 07-162, a Resolution approving the bid award for the Bondurant Public Safety Building Site Work.  Roll Call:  Kromrie-Yes, Cordes-Yes, Bailey-Yes, Ryan-Yes, Adams-Yes.  Motion carried.

 

Mr. Ron Sinn, 101 – 3rd Street, Northeast, Bondurant, Iowa, was denied his request to have the “no parking” area changed on 3rd Street, Northeast, Bondurant, Iowa.   

 

City Attorney Brick will present options for amending the Code of Ordinances pertaining to   parking on hard surface at the December 03 meeting.

 

Mayor McCoid called a recess at 7:10 p.m.  The meeting reconvened at 7:15 p.m.

 

Motion made by Council Member Bailey, seconded by Council Member Ryan, to go into closed session, pursuant to Iowa Code Section 21.5(j) to discuss the potential sale of City property.  Roll Call:  Bailey-Yes, Ryan-Yes, Kromrie-Yes, Cordes-Yes, Adams-Yes.  Motion approved.  Council went into closed session at 7:15 p.m.  Motion made by Council Member Kromrie, seconded by Council Member Bailey to close the closed session and open the regular meeting.  Roll Call:  Kromrie-Yes, Bailey-Yes, Adams-Yes, Ryan-Yes, Cordes-Yes.  Motion carried.  The regular meeting opened at 7:25 p.m.
