NOTICE IS HEREBY GIVEN that a Regular Meeting of the City Council will be held at 6:00 p.m. on Monday, August 20, 2007, in the Bondurant City Center at 200 Second Street, Northeast, Bondurant, Polk County, Iowa.  Said meeting is open and the public is encouraged to attend.

Meeting No. 07-20

 

A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City Center on the 20th day of August, 2007, at 6:00 p.m.

 

 

Present:               Mayor Marla McCoid

                              Council Member Mike Adams, Sr.

                              Council Member Michele R. Bailey

                              Council Member Bruce N. Cordes

Council Member Jeffrey A. Kromrie

                              Council Member Keith Ryan

                              City Administrator Mark J. Arentsen

Notice of the meeting was posted at the Bondurant City Center, Casey’s General Stores, Legacy Bank and the United States Post Office on August 17, 2007.  All proceedings hereafter shown were taken while the convened meeting was open to the public.

 

Mayor McCoid called the meeting to order at 6:02 p.m.  Roll call was taken and  a quorum was declared.

 

Motion made by Council Member Bailey, seconded by Council Member Adams, to approve the agenda as presented.  Roll Call:  Bailey-Yes, Adams-Yes, Cordes-Yes, Kromrie-Yes, Ryan-Yes.    Motion carried. 

 

Motion made by Council Member  Adams, seconded by Council Member Bailey, to approve the consent items consisting of the City Council Minutes of August 06, 2007, the Claims Report, and Tax Abatement Application for Prisilla A. Ford, 301 Mulberry Drive, Northwest, Bondurant, Polk County, Iowa.  Roll Call:  Adams-Yes, Bailey-Yes, Kromrie-Abstain, Ryan-Yes, Cordes-Yes.  Motion carried.

 

Polk County Sheriff’s Department representative had nothing to report. 

 

Motion made by Council Member Bailey, seconded by Council Member Adams, to defer item #7

and said item will be defined as item #12a.  Roll Call:  Bailey-Yes, Adams-Yes, Cordes-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Adams, to defer item #8 and said item will be defined as item #12b.  Roll Call:  Cordes-Yes, Adams-Yes, Bailey-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.

Motion made by Council Member Bailey, seconded by Council Member Adams, to table Resolution No. 07-125, a Resolution authorizing the approval of an Intergovernmental Agreement Establishing the Iowa Cities E-Payment Aggregation System, until a representative is present to answer Council Member questions.  Roll Call:  Bailey-Yes, Adams-Yes, Cordes-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Adams, to approve Resolution No. 07-126, a Resolution approving the Annexation Petition and Agreement, as amended, between the City of Bondurant, Polk County, Iowa, and Erik and Kami Olesen, 7555, Northeast 86th Avenue, Bondurant, Polk County, Iowa.  Roll Call:  Bailey-Yes, Adams-Yes, Cordes-Yes, Kromrie, Yes, Ryan-Yes.  Motion carried.

 

Mr. Eric Gjersvik, Bartlett & West Engineers, presented the Final Plat for Clarence Oleson Vista Estates Plat 5 and answered questions from the Mayor and Council.  Motion made by Council Member Kromrie, seconded by Council Member Cordes, to approve Resolution No. 07-127, a Resolution approving the Final Plat for Clarence Oleson Vista Estates Plat 5.  Roll Call:  Kromrie-Yes, Cordes-Yes, Adams-Abstain, Bailey-Yes, Ryan-Yes.  Motion carried. 

 

Mayor McCoid called for a recess at 6:40 p.m.  The Council meeting reconvened at 6:55 p.m.

 

Motion made by Council Member Ryan, seconded by Council Member Bailey, to approve Resolution No. 07-128, a Resolution approving a Right of First Refusal Land Purchase Agreement between the City of Bondurant, Polk County, Iowa, and Don Newby.  Roll Call:  Ryan-Yes, Bailey-Yes, Adams-Yes, Cordes-Yes, Kromrie-Yes.  Motion carried.

 

Mr. John Bein, Planning and Zoning Commission Chair, answered questions from the Mayor and Council pertaining to parkland dedication.  Motion made by Council Member Bailey, seconded by Council Member Adams, to waive the second reading of Ordinance No. 07-216, an Ordinance amending Chapter 178 of the Zoning Code of the City of Bondurant, Iowa, “R-2” One-Family and Two-Family Residential District, by adding Subsection 178.03(5) on Parkland Dedication, which provides a formula, definitions, requirements and criteria to govern land area devoted to open space and landscaping and approve as the third and final reading.  Roll Call:  Bailey-Yes, Adams-Yes, Cordes-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council member Adams, to waive the second reading of Ordinance No. 07-217, an Ordinance amending Chapter 178 of the Zoning Code of the City of Bondurant, Iowa, “R-3” Multi-Family Residential District, by adding Subsection 178.04(6) on Parkland Dedication, which provides a formula, definitions, requirements and criteria to govern land area devoted to open space and landscaping and approve as the third and final reading.  Roll Call:  Bailey-Yes, Adams-Yes, Cordes-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.

 

Mayor McCoid led a discussion concerning the need to enforce ordinances pertaining to junk and junk vehicles.

Mayor McCoid left the meeting at 7:25 p.m.  Mayor Pro Tem Bailey presided over the remainder of the meeting.

 

City Administrator Arentsen gave an update on the rail line.

 

The following item(s) were discussed as part of City Administrator Arentsen’s comments:

 

·            Dr. Pick’s dental office opened August 20th.

·            Bid ads for the Public Safety Building and the Library will be published on August 29th.

 

The following item(s) were discussed as part of Council Member’s comments:

·             

·            Council Member Bailey – Asked when DART bus service will begin.

·            Council Member Adams – Asked for update on the sidewalk project and railroad track repair on Grant Street, North.

·            Council Member Ryan – Asked status of radar gun for 15th Street, Southeast.

·            Council Member Kromrie – New fire truck chassis is at the manufacturer.

·            Council Member Cordes – No Comment.
