A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City Center on the 16th day of July, 2007, at 6:00 p.m.

 

 

Present:               Mayor Marla McCoid

                              Council Member Mike Adams, Sr.

                              Council Member Michele R. Bailey

                              Council Member Bruce N. Cordes

Council Member Jeffrey A. Kromrie

                              Council Member Keith Ryan

                              City Administrator Mark J. Arentsen

Notice of the meeting was posted at the Bondurant City Center, Casey’s General Stores, Legacy Bank and the United States Post Office on July 13, 2007.  All proceedings hereafter shown were taken while the convened meeting was open to the public.

 

Mayor McCoid called the meeting to order at 6:00 p.m.  Roll call was  taken and  a quorum was declared.

 

Motion made by Council Member Kromrie, seconded by Council Member Bailey, to approve the agenda as presented.  Roll Call:  Bailey-Yes, Adams-Yes, Cordes-Yes, Kromrie-Yes, Ryan-Yes.    Motion carried. 

 

Motion made by Council Member  Bailey, seconded by Council Member Adams, to approve the consent items consisting of the City Council Minutes of July 02, 2007, Library Board of Trustees Minutes of June 14, 2007, the Claims Report and Tax Abatement Applications for Sarah Mullen, 1303 Adams Street, Southeast; BIG LLC, 3300 Henry Street, Southwest; and Chelsea Holdridge, 1000 – 14th Street, Southeast, Bondurant, Polk County, Iowa.  Roll Call:  Bailey-Yes, Adams-Yes, Cordes-Yes, Ryan-Yes, Kromrie-Yes.  Motion carried.

 

Polk County Sheriff’s Department representative Lt. Peterman had nothing to report.  Council Member Bailey asked Polk County to monitor curfew. 

 

Mr. Bill Peard, Senior Manager of Government Relations, Mediacom Communications Corporation, presented the Cable Television Franchise Agreement between the City of Bondurant and Mediacom Communications Corporation and answered questions from the Mayor and Council.  Motion made by Council Member Bailey, seconded by Council Member Cordes, to waive the first and second reading of Ordinance No. 07-215, an Ordinance amending  the  Code of  Ordinances of the City of Bondurant, Iowa, 2002, by  adding provisions

granting a cable television franchise to MCC Iowa, and approve as the third and final reading.  Roll Call:  Bailey-Yes, Cordes-Yes, Kromrie-Yes, Adams-Yes, Ryan-Yes.  Motion carried.

 

Mr. Bob Watts, Bloom Builders Company, presented the Site Plan for Richard Downs commercial building, 1925 Hubbell Road, Southwest, Bondurant, Iowa, a legal description showing the distance of the building to the flood plain and written communication from the Iowa Department of Transportation pertaining to an entrance permit.  Motion made by Council Member Bailey, seconded by Council Member Cordes, to approve Resolution No. 07-113, a Resolution approving the Site Plan for Richard Downs commercial building, 1925 Hubbell Road, Southwest, Bondurant, Iowa.  Roll Call:  Bailey-Yes, Cordes-Yes, Adams-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.

 

Ms. Susan Ugulini, Library Board of Trustees President, presented an Agreement for Architectural Services between the City of Bondurant and FEH Associates, Inc., for library construction and answered questions from the Mayor and Council.  Motion made by Council Member Bailey, seconded by Council Member Adams, to approve Resolution No. 07-114, a Resolution approving the Agreement for Architectural Services between the City of Bondurant and FEH Associates, Inc., for library construction.  Roll Call:  Bailey-Yes, Adams-Yes, Kromrie-Yes, Ryan-Yes, Cordes-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Bailey, to approve Resolution No. 07-115, a Resolution setting a public hearing date for August 06, 2007, at 6:00 p.m., in the Community Room at the Bondurant City Center to receive public comment on the City of Bondurant 2007 portion of the Street Reconstruction Phase I Sidewalk Improvement Project.  Roll Call:  Cordes-Yes, Bailey-Yes, Adams-Yes, Ryan-Yes, Kromrie-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Kromrie, to approve Resolution No. 07-116, a Resolution setting a public hearing date for August 06, 2007, at 6:00 p.m., in the Community Room at the Bondurant City Center for consideration of amending Chapter 178 of the Zoning Code- District Regulations.  Roll Call:  Cordes-Yes, Kromrie-Yes, Bailey-Yes, Ryan-Yes, Adams-Yes.  Motion carried.           

 

Motion made by Council Member Bailey, seconded by Council Member Adams, to approve Resolution No. 07-117, a Resolution authorizing and directing the City Administrator to write-off certain emergency medical accounts as non-collectible.  Roll Call:  Bailey-Yes, Adams-Yes, Kromrie-Yes, Cordes-Yes, Ryan-Yes.  Motion carried.

 

City Administrator Arentsen led a discussion concerning the policies being utilized to monitor unbilled water consumption.

 

The following item(s) were discussed as part of City Administrator Arentsen’s comments:

 

v  Thanked Street Superintendent Ken Grove for his quick response in assisting with a recent fire.

Mayor McCoid called a recess at 6:50 p.m.  Council reconvened at 6:59 p.m.

 

Motion made by Council Member Adams, seconded by Council Member Cordes, to go into closed session pursuant to Iowa Code Section 21.5(c) to discuss strategy with counsel, via conference call, in matters involving litigation where its disclosure would be likely to prejudice or disadvantage the position of the governmental body.  Roll Call:  Adams-Yes, Cordes-Yes, Bailey-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.  Council went into closed session at 7:00 p.m.  Motion made by Council Member Adams, seconded by Council Member Cordes, to close the closed session and open the regular meeting.  Roll Call:  Adams-Yes, Cordes-Yes, Bailey-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.  The regular meeting opened at 7:15 p.m.
