Meeting No. 06-28

 

 

A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City  Center on the 20th day of November, 2006, at 6:00 p.m.

Notice of the meeting was posted at the Bondurant City Center, Casey’s General Stores, Legacy Bank and the United States Post Office on November 17, 2006.  All proceedings hereafter shown were taken while the convened meeting was open to the public.

 

Mayor McCoid called the meeting to order at 6:15 p.m.  Roll call  was  taken and  a quorum was declared.

 

Mayor McCoid announced that item #7 would be removed from the agenda.  Motion made by Council Member Cordes, seconded by Council Member Bailey, to approve the agenda, as amended.  Roll Call:  Cordes-Yes, Bailey-Yes, Adams-Yes, Ryan-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Ryan, to approve the consent items consisting of the City Council Minutes of November 06, 2006, Library Board of Trustees Minutes of October 26, 2006, and Tax Abatement Applications for Jessi Collison, 1404 Adams Street, Southeast, and Diane Christensen, 800 Cleveland Avenue, Southeast, Bondurant, Polk County, Iowa.  Roll Call:  Bailey-Yes, Ryan-Yes, Adams-Yes, Cordes-Yes.  Motion carried.

 

Polk County Sheriff’s Department Captain Jorgenson introduced Lt. Greg Peterman, gave an update concerning citation revenue and said he has enjoyed working in Bondurant for many years.  Mayor McCoid and Council thanked him for his dedicated service to the community.

 

Motion made by Council Member Adams, seconded by Council Member Ryan, to approve Resolution No. 06-175, a Resolution approving the State of Iowa Annual Financial Report for Fiscal Year 2006.  Roll Call:  Adams-Yes, Ryan-Yes, Bailey-Yes, Cordes-Yes.  Motion carried.

Council Member Kromrie arrived at 6:24 p.m.

 

Motion made by Council Member  Bailey, seconded by Council Member Ryan, to close the regular City Council meeting and open the Public Hearing, for consideration of a developer’s agreement between the City of Bondurant, Polk County, Iowa, and Wil-Ron Properties, L.L.C.  Roll Call:  Bailey-Yes, Ryan-Yes, Adams-Yes, Kromrie-Yes, Cordes-Yes.  Motion carried.  Mr. Ed Skinner, Skinner Law Office, presented the developer’s agreement and answered questions from the Mayor and Council.  Mr. Michael Adams, Jr., 210 – 2nd Street, Northeast, Bondurant, Polk County, Iowa, asked if development agreements of this kind would be a new philosophy for the City, relating to future commercial projects that he has.  City Administrator Arentsen said that commercial TIF’s that are a rebate format are good for the City because the new property valuation created in the TIF area is not exempted for debt service levy taxes, i.e., the new valuation pays debt service related taxes as soon as it is completed for the City, County and school district debt purposes.  It also pays taxes for the school district physical plant and equipment levy.  In addition, the developer pays up front for any infrastructure costs funded through the TIF.  The developer is reimbursed only when taxable valuation is built and property taxes are paid on the new building(s).  The developer receives reimbursement as property taxes are paid on the new building(s) and only in an amount agreed to previously by the City.

 

Mayor McCoid stated that the City is moving in a direction of promoting commercial growth and seeing the tax valuations there.  Motion made by Council Member Bailey, seconded by Council Member Ryan, to close the Public Hearing and open the regular City Council meeting.  Roll Call:  Bailey-Yes, Ryan-Yes, Adams-Yes, Cordes-Yes, Kromrie-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Ryan, to approve Resolution No. 06-162, a Resolution approving the developer’s agreement between the City of Bondurant, Polk County, Iowa, and Wil-Ron Properties, L.L.C.  Roll Call:  Bailey-Yes, Ryan-Yes, Adams-No, Kromrie-Yes, Cordes-Yes.  Motion carried.

 

Mayor McCoid called for a recess at 7:10 p.m.  Council reconvened at 7:15 p.m.

 

Motion made by Council Member  Bailey, seconded by Council Member Cordes, to close the regular City Council meeting and open the Public Hearing, for consideration of a sewer revenue loan and disbursement agreement in the amount of $1,175,000.00.  Roll Call:  Bailey-Yes, Cordes-Yes, Adams-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.  No verbal comments were received during the Public Hearing.  Motion made by Council Member Bailey, seconded by Council Member Ryan, to close the Public Hearing and open the regular City Council meeting.  Roll Call:  Bailey-Yes, Ryan-Yes, Adams-Yes, Kromrie-Yes, Cordes-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Bailey, to approve Resolution No. 06-172, a Resolution approving a sewer revenue loan and disbursement agreement in the amount of $1,175,000.00.  Roll Call:  Cordes-Yes, Bailey-Yes, Adams-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.

Motion made by Council Member Bailey, seconded by Council Member Ryan, to close the regular City Council meeting and open the Public Hearing, for consideration of amending the Official Zoning Map of the Code of Ordinances of the City of Bondurant, Iowa, 2002, for the downtown area from R-3 Multi-Family; and C-2 Commercial area to C-4 Central Business District.  Roll Call:  Bailey-Yes, Ryan-Yes, Adams-Yes, Kromrie-Yes, Cordes-Yes.                     Motion carried.  Mr. Michael Adams, Jr., 210 – 2nd Street, Northeast, Bondurant, Polk County, Iowa,  stated  that  he  is  in  favor of  the  rezoning.  Motion  made  by  Council  Member Bailey,

Motion made by Council Member Bailey, seconded by Council Member Ryan, to waive the first and second reading of Ordinance No. 06-212, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, for the downtown area from R-3 Multi-Family; and C-2 Commercial area to C-4 Central Business District and approve as the third and final reading.  Roll Call:  Bailey-Yes, Ryan-Yes, Adams-Yes, Kromrie-Yes, Cordes-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Ryan, to approve Resolution No. 06- 173, a Resolution establishing a Public Hearing date of December 04, 2006, at 6:00 p.m. in the community room of the Bondurant City Center to consider the Code of Ordinances of the City of Bondurant, Polk County, Iowa, 2002, with respect to Architectural Standards – Chapter 179.  Roll Call:  Bailey-Yes, Ryan-Yes, Adams-Yes, Kromrie-Yes, Cordes-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Cordes, to approve Resolution No. 06-174, a Resolution establishing the meeting dates for the month of January, 2007, as January 08 and January 22, at 6:00 p.m. in the community room at the Bondurant City Center.  Roll Call:  Bailey-Yes, Cordes-Yes, Adams-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.

 

Public Financial Management, Inc., will present the City of Bondurant’s financial status at the regular City Council meeting on December 18.

 

The following item(s) were discussed as part of City Administrator Arentsen’s comments:

 

v     Asked for Council comments concerning a recent noise complaint.

v     Sludge removal project scheduled to start the week of November 27.

v     There will be an informational meeting on January 24, with property owners along U.S. Highway 65 and on February 22, with area developers.

v     Banking bids are due on November 30.

v     Newsletter deadline is December 1.

q       Council Member Ryan – Asked the status of the new roof for the bank building and doesn’t think there is much progress removing the debris at the former Union 76 building.

q       Council Member Kromrie – Fire station update.

q       Council Member Adams – No Comment.

q       Council Member Cordes – No Comment.

 

The following item(s) were discussed as part of Mayor McCoid’s comments:

 

ü      Legislation update.

ü      Was disappointed with FEH presentation at the City Council / Library Board work session.

ü      Met on Monday with Bondurant Development, Inc., some local developers and Don Coates, Eastern Polk County Regional Development, with regard to pursuing economic development along the corridor.
