A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City  Center on the 16th day of October, 2006, at 6:00 p.m.

 

 

Present:                Mayor Marla McCoid

                              Council Member Mike Adams, Sr.

                              Council Member Michele R. Bailey

                              Council Member Bruce N. Cordes

                              Council Member Jeffrey A. Kromrie

                              Council Member Keith Ryan     

                              City Administrator Mark J. Arentsen

Absent:                 None

 

Notice of the meeting was posted at the Bondurant City Center, Casey’s General Stores, Legacy Bank and the United States Post Office on October 13, 2006.  All proceedings hereafter shown were taken while the convened meeting was open to the public.

 

Mayor McCoid called the meeting to order at 6:00 p.m.  Roll call  was  taken and  a quorum was declared.

 

Motion made by Council Member Cordes, seconded by Council Member Bailey, to approve the agenda, as presented.  Roll Call:  Cordes-Yes, Bailey-Yes, Adams-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.

 

Motion made by Council Member Kromrie, seconded by Council Member Bailey, to approve the consent items consisting of the City Council Minutes of October 02, 2006, Planning and Zoning Commission Minutes of September 14, 2006, Tax Abatement Study Committee Minutes of September 21, 2006, Library Board of Trustees Minutes of September 07, 2006, and Tax Abatement Application for T. J. Werner, 311 Mulberry Drive, Northwest, Bondurant, Polk County, Iowa.  Roll Call:  Kromrie-Yes, Bailey-Yes, Adams-Yes, Cordes-Yes, Ryan-Yes.  Motion carried.

 

Polk County Sheriff’s Department Lt. Jorgenson announced his promotion to Captain and his semi-retirement, effective January 01, 2007.  Mayor McCoid thanked Captain Jorgenson for his many years of dedicated service to the City of Bondurant.

 

Mr. Donald Newby, 7774 Northeast 94th Avenue, Bondurant, Polk County, Iowa, presented a Preliminary Plat for Sharon Acres Plat 2 and answered questions from the Mayor and Council.

Motion made by Council Member Adams, seconded by Council Member Bailey, to approve Resolution No. 06-149, a Resolution approving the Preliminary Plat for Sharon Acres Plat 2, located in rural Polk County, Iowa.  Roll Call:  Adams-Yes, Bailey-Yes, Kromrie-Yes, Cordes-Yes, Ryan-Yes.  Motion carried.

 

Ms. Michelle Meyer, State Auditor’s Office, presented the FY 2006 City audit.  Motion made by Council Member Bailey, seconded by Council Member Cordes, to approve Resolution No. 06-150, a Resolution approving the Financial Statements and Supplementary Data, for the Fiscal Year ended June 30, 2006, for the City of Bondurant, Polk County, Iowa, prepared by the Office of Auditor of State.  Roll Call:  Bailey-Yes, Cordes-Yes, Adams-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Ryan, to approve Resolution No. 06-151, a Resolution establishing a Public Hearing for consideration of a rezoning request for the Farmer’s Cooperative Company, located at 8200 Northeast 78th Avenue, Bondurant, Polk County, Iowa, from A-1, Agricultural to M-2, Medium Industrial, for the 06th day of November, 2006, at 6:00 p.m. in the Community Room at the Bondurant City Center, Bondurant, Polk County, Iowa.  Roll Call:  Bailey-Yes, Ryan-Yes, Adams-Yes, Kromrie-Yes, Cordes-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Cordes, to approve Resolution No. 06-152, a Resolution establishing a Public Hearing for consideration of a Developer’s Agreement between the City of Bondurant, Polk County, Iowa, and Wil-Ron Properties, L.L.C., for the 06th day of November, 2006, at 6:00 p.m., in the Community Room at the Bondurant City Center, Bondurant, Polk County, Iowa.  Roll Call:  Bailey-Yes, Cordes-Yes, Adams-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.

 

Mayor McCoid called for a recess at 6:50 p.m.  Council reconvened at 6:56 p.m.

 

Motion made by Council Member Kromrie, seconded by Council Member Ryan, to approve Resolution No. 06-153, a Resolution approving the Tax Abatement Study Committee recommendation to eliminate the 3-year residential tax abatement at 80% and amend the current 5-year abatement schedule as 80%, 65%, 50%, 35%, 20%.  This schedule would become effective July 01, 2008, and should be reviewed periodically.  The commercial tax abatement schedule will remain as is.  Roll Call:  Kromrie-Yes, Ryan-Yes, Adams-Yes, Bailey-Yes, Cordes-Yes.  Motion carried.

 

Motion made by Council Member Kromrie, seconded by Council Member Bailey, to approve Resolution No. 06-154, a Resolution authorizing and directing the City Administrator to write-off certain medical emergency service accounts as non-collectible.  Roll Call:  Kromrie-Yes, Bailey-Yes, Adams-Yes, Cordes-Yes, Ryan-Yes.  Motion carried.

 

Motion made by Council Member Ryan, seconded by Council Member Cordes, to approve Resolution No. 06-155, a Resolution approving the renewal license for off-premise liquor, wine or beer  application for  Polito’s Pizza House, a  privately  held  corporation  d/b/a Polito’s  Pizza

Motion made by Council Member Adams, seconded by Council Member Bailey, to approve Resolution No. 06-156, a Resolution approving the renewal license for off-premise liquor, wine or beer application for Casey’s Marketing Company, a privately held corporation, d/b/a Casey’s General Store #1373, 302 – 2nd Street, Northeast, Bondurant, Polk County, Iowa.  Roll Call:  Adams-Yes, Bailey-Yes, Kromrie-Yes, Cordes-Yes, Ryan-Yes.  Motion carried.

 

Motion made by Council Member Adams, seconded by Council Member Cordes, to approve Resolution No. 06-157, a Resolution approving the Metro Waste Authority grant application on behalf of the City of Bondurant, Polk County, Iowa.  Roll Call:  Adams-Yes, Cordes-Yes, Bailey-Yes, Kromrie-Yes, Ryan-Yes.  Motion carried.

 

Resolution No. 06-158, a Resolution approving the 28E Agreement for the Metro Home Improvement Program is tabled.

 

Mayor McCoid led a discussion concerning the piles of debris at the former Union 76 site, located within the corporate limits of the City of Bondurant, that were deposited by Environmental Reclamation and Recycling (ERR), 1422 Scott Avenue, Des Moines, Iowa.  Attorney Brad Skinner, Skinner Law Office, 204 – 8th Street, Southeast, Altoona, Iowa, was present as Counsel for Environmental Reclamation and Recycling together with Mr. Derrick Walker, Operations Manager for ERR.  Mr. Skinner and Mr. Walker will bring a status report on the removal of the debris to the November 06, 2006, Council meeting. 

 

City Administrator Arentsen led a discussion regarding a potential tenant for the former Legacy bank building.

 

Mayor McCoid asked City Administrator Arentsen to research the costs associated with City Police Departments.

 

Mayor McCoid led a discussion concerning the replacement and / or installation of sidewalks and appointed Council Member Adams to a sidewalk study committee.
