NOTICE IS HEREBY GIVEN that a Regular Meeting of the City Council will be held at 6:00 p.m. on Monday, September 18, 2006, in the Bondurant City Center at 200 Second Street, Northeast, Bondurant, Polk County, Iowa.  Said meeting is open and the public is encouraged to attend.

A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City  Center on the 18th day of September, 2006, at 6:00 p.m.

Notice of the meeting was posted at the Bondurant City Center, Casey’s General Stores, Legacy Bank and the United States Post Office on September 15, 2006.  All proceedings hereafter shown were taken while the convened meeting was open to the public.

 

Mayor McCoid called the meeting to order at 6:00 p.m.  Roll call  was  taken and  a quorum was declared.

 

Motion made by Council Member Kromrie, seconded by Council Member Cordes, to approve the agenda, as presented.  Roll Call:  Kromrie-Yes, Cordes-Yes, Adams-Yes, Ryan-Yes.  Motion carried.

 

Motion made by Council Member Kromrie, seconded by Council Member Ryan, to approve the consent items consisting of the City Council Minutes of September 05, 2006, Planning and Zoning Commission Minutes of August 24, 2006, Bondurant Community Library Board of Trustees Minutes of August 30, 2006, the Claims Report and Tax Abatement Applications for Charlette Mullen, 204 – 14th Street, Southeast; and Laura J. Adams, 603 – 14th Street, Southeast, Bondurant, Polk County, Iowa.  Roll Call:  Kromrie-Yes, Ryan-Yes, Adams-Yes, Cordes-Yes.  Motion carried.

 

Polk County Sheriff’s Department Lt. Jorgenson was present but had nothing to report.

 

Mr. Chris Pearson, VP, Feed Division / Region 6 Manager, Farmer’s Cooperative Company, 105 Garfield Avenue, Farnhamville, Iowa, presented the Temporary Site Plan for Farmer’s Cooperative Company, located at 8200 Northeast 78th Avenue, Bondurant, Polk County, Iowa, and answered questions from the Mayor and Council Members.  The Temporary Site Plan includes a portable scale and office to be completed this Fall and will expire March 01, 2007.

Farmer’s Cooperative plans to request a re-zoning for this site from Agricultural to M-2 Medium Industrial.  The re-zoning will allow for expansion and divert traffic across U.S. Highway 65.  There are plans for a berm or some type of windbreak on the west edge of the property.    Mrs. Sheryl Weston, 8122 Northeast 78th Avenue, Bondurant, Polk County, Iowa, questioned if the eventual re-zoning will give Farmer’s Cooperative more leeway with the Temporary Site Plan, or will they be limited to the Site Plan being submitted at this time.  City Administrator Arentsen said if there are any changes to the Temporary Site Plan, a new Site Plan would need to be approved by the Planning and Zoning Commission and the City Council.  Planning and Zoning Commission Chair Marvin Skinner requested that a future Site Plan be submitted by a licensed engineer and that detention ponds need to addressed.  

 

Motion made by Council Member Kromrie, seconded by Council Member Ryan, to approve Resolution No. 06-138, a Resolution approving the Temporary Site Plan for Farmer’s Cooperative Company, located at 8200 Northeast 78th Avenue, Bondurant, Polk County, Iowa.  Said Site Plan expires on March 01, 2007.  All improvements installed as a part of this Site Plan must be removed as of March 01, 2007, unless a new Site Plan has been approved prior to March 01, 2007.  Roll Call:  Kromrie-Yes, Ryan-Yes, Adams-Yes, Cordes-Yes.  Motion carried.

 

Motion made by Council Member Kromrie, seconded by Council Member Ryan, to approve Resolution No. 06-137, a Resolution allowing the residents of 14th Street, Southeast, Bondurant, Polk County, Iowa, to close 14th Street, Southeast, between Lincoln Street, Southeast, and Michael Street, Southeast, on Saturday, September 23, 2006, between the hours of 5:00 p.m. and Midnight, for a neighborhood block party.  Roll Call:  Kromrie-Yes, Ryan-Yes, Adams-Yes, Cordes-Yes.  Motion carried.

 

Resolution No. 06-139 was tabled until the next meeting.

 

Motion made by Council Member Kromrie, seconded by Council Member Adams, to waive the second reading of Ordinance No. 06-206, an Ordinance Amending the Code of Ordinances of the City of Bondurant, Polk County, Iowa, 2002, by adding Section 135.14 – “Utility Permit” and approve as the third and final reading.  Roll Call:  Kromrie-Yes, Adams-Yes, Cordes-Yes, Ryan-Yes.  Motion carried.

 

City Attorney Brick informed the Mayor and Council that during the previous City Administration, Chapter 27 – “Board of Adjustment” was deleted from the City’s Municipal Code.  Recently there was a need to review Chapter 27 and the error was discovered.  City Attorney Brick was able to recover the Chapter in his archives and forwarded it to City Hall, where it will be rewritten into the Municipal Code Book.  

 

Motion made by Council Member Cordes, seconded by Council Member Ryan, to waive the first and second reading of Ordinance No. 06-210, an Ordinance Amending the Code of Ordinances of the City of Bondurant, Polk County, Iowa, 2002, by adding Chapter 27 – “Board of Adjustment” and approve as the third and final reading.  Roll Call:  Cordes-Yes, Ryan-Yes, Adams-Yes, Kromrie-Yes.  Motion carried.

Mr. Josh Miller, 405 – 5th Street, Northwest, Bondurant, Polk County, Iowa, asked Council to consider making a recommendation to the Polk County Assessor and the Polk County Auditor that his tax abatement application be applied retroactive, due to special circumstances.  Mr. Miller said his realtor had admitted to “dropping the ball” in filing the tax abatement form by the deadline date and the abatement will not go into effect until 2007.

 

Motion made by Council Member Ryan, seconded by Council Member Cordes, to approve Resolution No. 06-140, a Resolution recommending to the Polk County Assessor and the Polk County Auditor that the Tax Abatement Application for 407 – 5th Street, Northwest, Bondurant, Polk County, Iowa, be applied retroactive, due to special circumstances.  Roll Call:  Ryan-Yes, Cordes-Yes, Adams-Yes, Kromrie-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Ryan, establishing the first meeting date in October for Monday, October 02, 2006, at 5:30 p.m.  Roll Call:  Cordes-Yes, Ryan-Yes, Adams-Yes, Kromrie-No.  Motion carried.

 

The following item(s) were discussed as part of City Administrator Arentsen’s comments:

 

v     Tax Abatement Review Committee Meeting on Thursday, September 21, at 6:00 p.m.

v     Special Census is 90% completed.

v     Presented a timeline for the re-zoning of the downtown area.

v     Engineer selection will be September 28, for the WRA sewer extension.

v     Bid opening will be September 28, for the 1st Street, Southeast, watermain project and sludge removal project at the wastewater treatment facility.

 

The following item(s) were discussed as part of Council Member’s comments:

 

q       Council Member Cordes – No Comment.

q       Council Member Ryan – A railcar sitting on the railroad tracks full of flammable liquid; currently working with Chief Kreuder on adjusting the Fire Department budget to meet their needs and concerned about the additional debris at the former Union 76 building, stating the area was to be cleaned up by October 01, 2006.

q       Council Member Kromrie – No Comment.

q       Council Member Adams –No Comment.

 

The following item(s) were discussed as part of Mayor McCoid’s comments:

 

ü      MILAG meeting update.

ü      Stressed the need for the Census count to be accurate.
