A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City Center on the 17th day of July, 2006, at 6:00 p.m.

Notice of the meeting was posted at the Bondurant City Center, Casey’s General Stores, Legacy Bank and the United States Post Office on July 14, 2006. All proceedings hereafter shown were taken while the convened meeting was open to the public.
Mayor McCoid called the meeting to order at 6:00 p.m. Roll call was taken and a quorum was declared.
Mayor McCoid asked that items #8 and #22 be removed from the agenda. Motion made by Council Member Kromrie, seconded by Council Member Ryan, to approve the agenda, as amended. Roll Call: Kromrie-Yes, Ryan-Yes, Adams-Yes, Bailey-Yes, Cordes-Yes. Motion carried.
Mr. Mike Adams, 7265 Northeast 105th Place, Bondurant, Polk County, Iowa, expressed his concern pertaining to an issue with the Polk County Sheriff’s Department.
Mr. Steven Wolvers, REMAX Suburban, 102 – 1st Street, Southeast, Bondurant, Polk County, Iowa, voiced his dissatisfaction with the way the City has issued past Code Enforcement violations for his business.

Polk County Sheriff’s Department Representative Lt. Jorgenson requested Bondurant Emergency Services assist Polk County with traffic control during RAGBRAI.
City Administrator Arentsen led a discussion concerning a proposed curfew ordinance. He will survey surrounding communities and bring a proposed ordinance for Council consideration to the August 07, 2006, City Council meeting.
Mr. Mike Adams, Adams Properties, 210B – 2nd Street, Northeast, Bondurant, Polk County, Iowa, presented Mayor McCoid with the deed for Lot B in Deer Ridge Crossing Plat 1.
Mr. David Bentz, P.E., Bishop Engineering Company, 3501 104th Street, Urbandale, Iowa, presented the Preliminary Plat for Mallard Creek Plat 1, located east of Northeast 64th Street and north of 2nd Street, Northwest, and answered questions from the Mayor and Council.
Motion made by Council Member Bailey, seconded by Council Member Ryan, to approve Resolution No. 06-101, a Resolution approving the Preliminary Plat for Mallard Creek Plat 1, located north of 2nd Street, Northwest, and east of Northeast 64th Street, Bondurant, Polk County, Iowa. Roll Call: Bailey-Yes, Ryan-Yes, Adams-Yes, Kromrie-Yes, Cordes-Yes. Motion carried.
Motion made by Council Member Bailey, seconded by Council Member Ryan, to close the regular City Council meeting and open the Public Hearing to consider amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by adding Architectural Standards to Chapter 179. Roll Call: Bailey-Yes, Ryan-Yes, Adams-Yes, Kromrie-Yes, Cordes-Yes. Motion carried. City Administrator Arentsen said proposed Ordinance 06-204 pertains to all buildings except one and two family dwellings, and mainly addresses screening of negative aspects of the building and hard surface requirements. Mayor McCoid said that the City doesn’t have anything in the Code prohibiting the additional construction of pole buildings. Mr. Mike Adams, Adams Properties, 210B – 2nd Street, Northeast, Bondurant, Polk County, Iowa, stated that he was also speaking on behalf of Steve Stoner Construction and they feel the Code of Ordinances does need to be more defining, but asked Council not to make it too restrictive. Mayor McCoid said the front of the building should be the main concern and by limiting the materials on the sides and back of a building would drive construction costs so high, making commercial development in the City not economically feasible. Council will provide City Administrator Arentsen with their comments and suggestions and these will be addressed at the next City Council Meeting. Motion made by Council Member Bailey, seconded by Council Member Kromrie, to close the Public Hearing and open the regular City Council meeting. Motion made by Council Member Bailey, seconded by Council Member Ryan, to close the regular City Council meeting and open the Public Hearing to consider amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by Adding Size Limitations to the Definition of “Decks”. Roll Call: Bailey-Yes, Ryan-Yes, Adams-Yes, Kromrie-Yes, Cordes-Yes. Motion carried. Council Member Bailey said that residents are wanting to build bigger decks than what our Ordinance allows and because lots vary in size, the Planning and Zoning Commission approved the amendment as a percentage rather than a dimension. Motion made by Council Member Bailey, seconded by Council Member Kromrie, to close the Public Hearing and open the regular City Council meeting. Mayor McCoid asked Mayor Pro Tem Bruce Cordes to preside over the discussion concerning Resolution No. 06-107, a Resolution approving an Agreement between the City of Bondurant, Polk County, Iowa, and Stanley Consultants, Inc., pertaining to Main Street, Southeast and 1st Street, Southeast intersection improvements. Council authorized City Administrator Arentsen to work with Stanley Consultants, Inc., and bring back proposals for three phases of street improvements for Main Street, Southeast / Northeast, from 2nd Street, Southeast, to 2nd Street, Northeast. Resolution No. 06-107 is tabled until the August 07, 2006, City Council meeting.

v Tax Abatement Committee will meet July 20th, at 6:00 p.m. at the City Center.
v Will be meeting on July 20th, to discuss engineer selection for the WRA project.
v Will be meeting with Polk County regarding negotiating a fee to provide Emergency Services for Douglas and Franklin Townships.
v Audit work for Fiscal Year 2005 / 2006 will begin July 24th.

q Council Member Cordes – Thanked City Staff for their assistance with Summer Fest.

q Council Member Bailey – The next RAGBRAI meeting will be Wednesday, July 19, 2006, at 6:30 p.m. and additional help is needed; appreciates all of the time that City Staff has put in for RAGBRAI and thanked Sue Ugulini for donating her legal services regarding the acquisition of the former bank building.
q Council Member Kromrie – Thanked everyone from the City that is promoting a positive attitude. He recently met with Polk County staff that expressed how wonderful it is working with the City now.
