A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City Center on the 03rd day of April, 2006, at 6:00 p.m.

Notice of the meeting was posted at the Bondurant City Center, Mobile Food Market, Casey’s General Store, and Legacy Bank on March 31, 2006. All proceedings hereafter shown were taken while the convened meeting was open to the public.
Mayor McCoid called the meeting to order at 6:01 p.m. Roll call was taken and a quorum was declared.
Mayor McCoid asked that item 16 be removed from the agenda, as the City has not received requested documents. Motion made by Council Member Bailey, seconded by Council Member Cordes, to approve the agenda, as amended. Roll Call: Bailey-Yes, Cordes-Yes, Adams-Yes, Ryan-Yes. Motion carried.
Motion made by Council Member Bailey, seconded by Council Member Ryan, to approve the consent items consisting of the City Council Minutes of March 20, 2006, Planning and Zoning Commission Minutes of March 09, 2006 and the Claims Report. Polk County Sheriff’s Department Representative Deputy Onley was present but had nothing to report.
Polk County Supervisor Tom Hockensmith presented an update on Polk County Government and answered questions from the Mayor and Council. The update included the Budget, Jail Financing, Polk County Land Use Map, Road Funding, Bondurant Rail Spur, Northeast Polk County Beltway, Northeast 56th Street Project, Rural Water and the Urban Service Area Wastewater Project.

Motion made by Council Member Cordes, seconded by Council Member Bailey, to approve Resolution No. 06-44, a Resolution approving applications for Voluntary Annexation of property in Section 25 into the City of Bondurant, Polk County, Iowa. Roll Call: Cordes-Yes, Bailey-Yes, Adams-Yes, Ryan-Yes. Motion carried.
Bondurant Men’s Club Representative Jerry Pritchard, requested the City serve as the Permit Holder for the supervised display of fireworks for Summerfest 2006.
Motion made by Council Member Bailey, seconded by Council Member Ryan, to approve Resolution No. 06-45, a Resolution approving the permit for supervised display of fireworks for the City of Bondurant, Polk County, Iowa, for Summerfest 2006. Roll Call: Bailey-Yes, Ryan-Yes, Adams-Yes, Cordes-Yes. Motion carried.
City Planner Mullenix presented the amended Sign Code and answered questions from the Mayor and Council. He said the amended Sign Code heavily favors monument signs and hopefully it will be less confusing than the current Sign Code.
Motion made by Council Member Cordes, seconded by Council Member Bailey, to approve the first reading of Ordinance No. 06-200, an Ordinance amending the Code of Ordinances of the City of Bondurant, 2002, by amending provisions pertaining to Chapter 181 – Sign Code. Roll Call: Cordes-Yes, Bailey-Yes, Adams-Yes, Ryan-Yes. Motion carried.
Motion made by Council Member Bailey, seconded by Council Member Cordes, to close the regular City Council meeting and open the Public Hearing to consider a re-zoning request in Section 25, north of 2nd Street, Northwest, and west of Mallard Pointe Drive, Northwest, Bondurant, Polk County, Iowa. Roll Call: Bailey-Yes, Cordes-Yes, Adams-Yes, Ryan-Yes. Motion carried.
Mr. David Bentz, P.E., L.S.I., Bishop Engineering, 3501 104th Street, Des Moines, Iowa, presented a re-zoning request of approximately 153.45 acres (+/-), located in Section 25, north of 2nd Street, Northwest, and west of Mallard Pointe Drive, Northwest, Bondurant, Polk County, Iowa, and answered questions from the Mayor and Council.
No public comment was received during the Public Hearing. Motion made by Council Member Cordes, seconded by Council Member Bailey, to close the Public Hearing and open the regular City Council Meeting. Roll Call: Cordes-Yes, Bailey-Yes, Adams-Yes, Ryan-Yes. Motion carried.
Motion made by Council Member Bailey, seconded by Council Member Ryan, to waive the first and second reading of Ordinance No. 06-201, an Ordinance amending the Official Zoning Map of the City of Bondurant, Polk County, Iowa, and approve as the third and final reading. Roll Call: Bailey-Yes, Ryan-Yes, Adams-Yes, Cordes-Yes. Motion carried.
Mayor McCoid asked if the property owner was present to address the Council concerning Resolution No. 06-46, a Resolution recommending to the Polk County Assessor and the Polk County Auditor that the Tax Abatement Application for Richard Wichael – 817 – 33rd Street,

Southwest, Bondurant, Polk County, Iowa, be applied retroactive due to special circumstances. The property owner was not present. Council Member Bailey asked that no action be taken until the property owner is present. City Administrator Arentsen will contact the property owner.

Motion made by Council Member Cordes, seconded by Council Member Bailey, to approve Resolution No. 06-48, a Resolution authorizing the City Administrator to sign and date the Notice to Proceed pertaining to the Section 29 Urban Services Area Wastewater Project. Mayor McCoid announced an error concerning the date for the Public Hearing in Resolution No. 06-49 and corrected said error. Motion made by Council Member Cordes, seconded by Council Member Ryan, to approve Resolution No. 06-49, a Resolution establishing a Public Hearing for Thursday, April 20, 2006, at 6:00 p.m., in the Community Room at the Bondurant City Center, to consider amending the Code of Ordinances of the City of Bondurant, 2002, by amending provisions pertaining to Chapter 180 – Subdivision Regulations, as amended. Roll Call: Cordes-Yes, Ryan-Yes, Adams-Yes, Bailey-Yes. Motion carried.
