Meeting No. 05-23

 

 

A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City Center on the 07th day of November, 2005, at 6:00 p.m.

Notice of the meeting was posted at the Bondurant City Center, Ampride Store, Casey’s General Store, and Legacy Bank on November 04, 2005.  All proceedings hereafter shown were taken while the convened meeting was open to the public.

 

Mayor Ihde  called  the meeting to  order at 6:06 p.m.  Roll call  was  taken and  a quorum was declared.

 

Motion made by Council Member Kromrie, seconded by Council Member Cordes, to approve the agenda, as  presented.   Roll Call:  Kromrie-Yes,  Cordes-Yes, Bailey-Yes, Valentine-Yes.   Motion carried.

 

Mr. Pat George, GTL Transportation, Inc. and Road-Ready Service, 250 Prairie Drive, Southwest, Bondurant, Iowa, said he was present to oppose the renewal contract for City Administrator Carlyle.  He said Mr. Carlyle’s attitude is arbitrary, he declines any responsibility where the City is concerned, procrastinates about decisions, and his conduct is more dictatorial than considerate and negotiable.  In general, his demeanor is not conducive to the prosperity of Bondurant, nor has it been. 

 

Mr. Paul Bettin, Bondurant Repair and Leasing, 902 – 2nd Street, Northeast, Bondurant, Iowa, said he was present to oppose the renewal contract for City Administrator Carlyle.  He said when Mr. Carlyle had grievances with him, he came to the City Center to talk to him and was denied being able to talk to him for a week.

 

Ms. Rita Rostenbach, 112 Blaine Street, Northwest, Bondurant, Iowa said she has a little different slant on things.  She said she has had disagreements with City Administrator Carlyle in the past, but has seen a change this past year.  Although there have been disagreements on things, when she has met with him  and  Mayor Ihde, she  felt she was heard  and respected.   Even  though  they  didn’t agree with her

opinion, they heard her concerns and invited her to join a committee, so that she could present her view on the issue.  She felt that she was treated respectfully and was very pleased with the outcome.

 

Ms. Deb Baker, 1009 Grant Street, South, Bondurant, Iowa, said she serves on the Bondurant Planning and Zoning Commission and has had the pleasure of working with City Administrator Carlyle for the last several years.  Like Rita, she said she just needed to get to know City Administrator Carlyle.  Until I really got into the Planning and Zoning Commission and working with the City on other projects, I really saw how much time he puts in for the City and he has always been very helpful.  For a time the City was shorthanded and he was spread pretty thin.   I’ve served on a lot of sub-committees as well, and he has always provided us with the information we needed.  I  am in favor of City Administrator Carlyle.  I feel that if we lose him in this City, we will be going backwards.  I do hope that is something people will think about, because until you spend a lot of time up here, you really don’t realize how much he puts into it.  People  should  look  at the big picture  and the  progress that  has been made since  he has been here.

 

Mr. Patrick George stated that he didn’t know if Mrs. Baker is in business or if the people are that are in support of City Administrator Carlyle.  Mayor Ihde announced to Mr. George that he could not argue against people that have just spoken, and question them about what they had said.  Mr. George answered that he wasn’t questioning her, but business people speak from a different standpoint than residents do.  The explanation that Mrs. Baker shows of City Administrator Carlyle is so different from my experience and from others that I know.  That’s why I question if she has an agenda.  I can look at City Administrator Carlyle and tell him that he has always been arbitrary and never negotiable.  It is always that Bondurant is not at fault and nothing is the City’s problem, it is always your problem.  I might also say that I think we are probably one of the five top tax payers, I’m sure we are one of the top ten.  He is not good for the progression of Bondurant.

 

Ms. Amy Bogaards, 707 Brick Street, Southeast, Bondurant, Iowa, said that if every resident and business owner of Bondurant could get up here and spend the time we might see a different perspective, but we can’t.  We can come to the City Council meetings and we see one side of things.  I had a personable problem with City Administrator Carlyle when I moved here four years ago, and it really put a dent in what I felt about the community.  He handled us in a way that was his way or whatever.  We ran into an emergency situation with an ambulance payment because someone had filed it incorrectly.  City Administrator Carlyle told me if it wasn’t an emergency situation, I shouldn’t have called 911.  After eighteen months it was determined to be an emergency situation.  That was my first contact with the City of Bondurant.  I got told that 911 is only for if you are almost dead.

 

Mr. Keith Ryan, 112 – 15th Street, Southeast, Bondurant, Iowa, stated that the speed limit signs on 15th Street, Southeast are too close to the street and asked if the they could be moved.  He thanked the Mayor and Council for the “Children at Play” signs on 15th Street, Southeast.

 

Motion made by Council Member Cordes, seconded by Council Member Kromrie, to approve the consent items consisting of the City Council Minutes of October 17, 2005, Library Board of Trustees Minutes of October 06, 2005, Eastern Polk Regional Development Minutes of October 13, 2005, the Claims Report and Tax Abatement Applications for David and Nicole Bell, 405 Tailfeather Court, Northwest; Keith and Jackie McLeod, 410 – 5th Street, Northwest; Trent and Heather Miller, 206 – 14th Street, Southeast; and Richard Waddington, 206 Walnut Drive, Northwest, Bondurant, Polk County, Iowa.  Roll Call:  Cordes-Yes, Kromrie-Yes, Bailey-Yes, Valentine-Yes.  Motion carried.

Polk County Sheriff’s Department Representative Lt. Jorgenson was present and reported on patrolling the City Park.

 

Polk County Supervisor Tom Hockensmith updated Council on Polk County Government. 

 

Motion made by Council Member Bailey, seconded by Council Member Cordes, to approve Resolution No. 05-122, a Resolution approving the Use of Facilities – Building Rental and Usage Contract between the City of Bondurant, Polk County, Iowa and the Bondurant-Farrar Community School District.  Roll Call:  Bailey-Yes, Cordes-Yes, Kromrie-Yes, Valentine-Yes.  Motion carried.

 

Mr. Leigh J. Bemus, Architectural Supervisor, Kirk Gross Company, 4015 Alexandra Drive, Waterloo, Iowa, presented the Site Plan for First Newton National Bank, located at 905 Washington Avenue, Southeast, Suite B, Bondurant, Polk County, Iowa.   City Planner Mullenix stated that the Site Plan has met the administrative review and has been approved by the Planning and Zoning Commission and recommended approval of said Site Plan. 

 

Motion made by Council Member Bailey, seconded by Council Member Valentine, to approve Resolution No. 05-123, a Resolution approving the Site Plan for First Newton National Bank located at 905 Washington Avenue, Southeast, Suite B, Bondurant, Polk County, Iowa.  Roll Call:  Bailey-Yes, Valentine-Yes, Kromrie-Yes, Cordes-Yes.  Motion carried.

 

Mayor Ihde and City Attorney Brick led a discussion concerning proposed Ordinance No. 05-221, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by enacting Chapter 48 titled “Residency Restrictions for Sex Offenders” within the corporate limits of the City of Bondurant, Polk County, Iowa, and answered questions from Council and residents.

 

Motion made by Council Member Kromrie, seconded by Council Member Cordes, to approve the first reading of Ordinance No. 05-221, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by enacting Chapter 48 titled “Residency Restrictions for Sex Offenders” within the corporate limits of the City of Bondurant, Polk County, Iowa.  Roll Call:  Kromrie-Yes, Cordes-Yes, Bailey-Yes, Valentine-Yes.  Motion carried.
