A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City Center on the 16th day of May, 2005, at 6:00 p.m.

Notice of the meeting was posted at the Bondurant City Center, Ampride Store, Casey’s General Store, and Legacy Bank on May 13, 2005.  All proceedings hereafter shown were taken while the convened meeting was open to the public.

 

Mayor Pro Tem Schiermeister  called the meeting  to  order at 6:02 p.m.  Roll  call  was  taken and a quorum was declared. 

 

Motion made by Council Member Bailey, seconded by Council Member Cordes, to approve the agenda, as presented.  Roll Call:  Bailey-Yes, Cordes-Yes, Kromrie-Yes, Schiermeister-Yes, Valentine-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Valentine, to approve the consent items consisting of the City Council Minutes of May 02, 2005, Polk County Aviation Authority Minutes of April 07, 2005, WRA Board Minutes of April 19, 2005, Eastern Polk Regional Development Board Minutes of April 14, 2005, Polk County Emergency MGMT Board Minutes of April 27, 2005, Metro Waste Authority Board Minutes of March 16, 2005, the Claims Report and Tax Abatement Applications for Brian Crook, 601 Spruce Circle, Northwest; Michael F. Polk County Sheriff’s Department Representative Lt. Jorgenson updated Council concerning the City’s deputy representation.

 

City Administrator Carlyle introduced Accounting Clerk Luane Baker.

Ms. Judi Mendenhall, Bondurant Chamber of Commerce Board Member, presented a Membership Application requesting the City of Bondurant become a Founding Member of the Bondurant Chamber of Commerce.  Ms. Mendenhall listed the Membership Benefits and Activities, adding that the Membership fee for Year 2-Gold is $500.00 and would expire December 31, 2006.

 

Council Member Kromrie asked how many people supported the City joining the Bondurant Chamber of Commerce, adding that he thinks the Chamber should be a separate entity and said he didn’t feel the City should be a member of the Bondurant Chamber of Commerce.  He said he called a couple of other cities and they don’t belong to their local Chamber of Commerce.  Council Member Cordes asked City Administrator Carlyle if he saw any problems with the City and the Chamber of Commerce having a conflict of interest.  City Administrator Carlyle said he is more accustomed with cities having memberships in Chambers of Commerce and Economic Development groups.  Council Member Bailey stated that when she attended a recent dinner, where the business owners she talked to all supported the City of Bondurant becoming a member of the Bondurant Chamber of Commerce.

 

Motion made by Council Member Valentine, seconded by Council Member Bailey, to approve Resolution No. 05-43, a Resolution approving the Membership Application to the Bondurant Chamber of Commerce.  Roll Call:  Valentine-Yes, Bailey-Yes, Kromrie-No, Cordes-Yes, Schiermeister-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Valentine, to approve Resolution No. 05-44, a Resolution approving a Proclamation declaring “Emergency Medical Services Week” in the City of Bondurant, Polk County, Iowa.  Roll Call:  Cordes-Yes, Valentine-Yes, Bailey-Yes, Schiermeister-Yes, Kromrie-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Valentine, to approve Resolution No. 05-45, a Resolution establishing a Public Hearing on May 28, 2005, at 9:00 a.m., on the proposed City of Bondurant, Polk County, Iowa, Fiscal Year 2004 / 2005 Amended Municipal Budget.  Roll Call:   Bailey-Yes,  Valentine-Yes,  Kromrie-Yes,  Cordes-Yes, Schiermeister-Yes.    Motion  carried.

 

City Administrator Carlyle led a discussion concerning the proposed Ordinance 05-207, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by amending provisions pertaining to stop required and four way stop intersections within the City of Bondurant, Polk County, Iowa.  The request was submitted on May 02, 2005, by Ms. Lori Reifert, 304 – 10th Street, Southeast and Ms. Beth Compton, 307 – 10th Street, Southeast, Bondurant, Iowa.  City Administrator Carlyle had asked Ms. Reifert to initiate a neighborhood meeting, which would include the Polk County Sheriff’s Department and the City of Bondurant.  He said the City has an interest of hearing from the neighbors as to a time period(s) when the speed concerns are present.  Ms. Compton stated that it was almost impossible to organize a neighborhood meeting at this time, as everyone is busy with softball and soccer.  City Administrator Carlyle said that the 2003 Edition of the Federal Highway Administration’s (FWHA’s) Manual on Uniform Traffic Control Devices (MUTCH) clearly states in Section 2B.05, Stop Sign Applications, that:  (1) stop signs should not be used for speed control; and (2) stop signs should be installed in a manner that minimizes the number of vehicles having to stop.  Because the proposed use of a stop sign(s) on 10th Street, Southeast, would directly conflict with these stated guidelines, it would  be his  recommendation  that  the stop  sign(s) not  be used in  this case.  He added, in the event

vehicles traveling on 10th Street, Southeast   using  excessive   speed,  the  solution should  be  increased   enforcement  of  the existing regulatory situation in the neighborhood, rather than placement of additional regulatory signage.  He recommended installing additional “Child At Play” and Speed Regulation signage on 10th Street, Southeast and increased speed enforcement from the Polk County Sheriff’s Department.

 

Motion made by Council Member Bailey, seconded by Council Member Kromrie, to waive the first and second reading of Ordinance No. 05-207, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by amending provisions pertaining to stop required and four way stop intersections within the City of Bondurant, Polk County, Iowa, and approve as the third and final reading.  Roll Call:  Bailey-Yes, Kromrie-Yes, Schiermeister-No, Valentine-No, Cordes-No.  Motion failed. 

 

Motion made by Council Member Valentine, seconded by Council Member Cordes, to waive the first and second reading of Ordinance No. 05-208, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by amending provisions pertaining to Schedule of Fees for Solid Waste Collection and Disposal Service, and approve as the third and final reading.  Roll Call:  Valentine-Yes, Cordes-Yes, Bailey-Yes, Kromrie-Yes, Schiermeister-Yes.  Motion carried.

City Administrator Carlyle asked Council Member Cordes to update Council regarding Mayor Ihde’s recent health issue.  Council Member Kromrie objected to this request during the meeting.

 

Motion made by Council Member Cordes, seconded by Council Member Bailey, to adjourn said meeting at 6:30 p.m.  Ayes:  5.  Nays:  0.  Motion carried.
