Meeting No. 05-09

 

 

A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City Center on the 02nd day of May, 2005, at 6:00 p.m.

 

 

Present:                Mayor Allen G. Ihde

                              Council Member Michele R. Bailey

                              Council Member Bruce N. Cordes

                              Council Member Jeffrey A. Kromrie

                              Council Member Gregory S. Schiermeister

                              Council Member James M. Valentine

                              City Administrator Darrel Steven Carlyle

Notice of the meeting was posted at the Bondurant City Center, Ampride Store, Casey’s General Store, and Legacy Bank on April 29, 2005.  All proceedings hereafter shown were taken while the convened meeting was open to the public.

 

Mayor Ihde  called the meeting  to  order at 6:00 p.m.  Roll  call  was  taken and a quorum was declared. 

 

Motion made by Council Member Cordes, seconded by Council Member Schiermeister, to approve the agenda, as presented.  Roll Call:  Cordes-Yes, Schiermeister-Yes, Bailey-Yes, Kromrie-Yes, Valentine-Yes.  Motion carried.

 

Ms. Lori Reifert, 304 – 10th Street, Southeast, Bondurant, Iowa and Ms. Beth Compton, 307 – 10th Street, Southeast, Bondurant, Iowa, requested a stop sign be placed at the Corner of Grant Court, Southeast and 10th Street, Southeast, in the vicinity of the above referenced addresses, in an effort to control speed.  Council Member Bailey asked for the request to be put on the next agenda for discussion.

 

Motion made by Council Member Bailey, seconded by Council Member Schiermeister, to approve the consent items consisting of the City Council Minutes of April 18, 2005, Des Moines Area MPO Minutes of March 17, 2005, the Claims Report, and Tax Abatement Application for Debra Sonderleiter, 508 – 15th Street, Southeast, Bondurant, Polk County, Iowa.  Roll Call:  Bailey-Yes, Schiermeister-Yes, Kromrie-Yes, Cordes-Yes, Valentine-Yes.  Motion carried. 

 

Polk County Sheriff’s  Department  Representative  Deputy Mohr was present but had nothing to  report.

He stated he would monitor the speed concerns on 10th Street, Southeast.

 

Mr. James Elza, AICP, Polk County Public Works, 5885 Northeast 14th Street, Des Moines, Iowa, presented the Urban Service Agreement(s) between Polk County the City of Bondurant and / or Jerry Homes, Inc. and answered questions from the Mayor and Council Members.

Motion made by Council Member Council Member Bailey, seconded by Council Member Cordes, to approve  Resolution No.  05-37,  a  Resolution  approving the  Joint City and County Urban Service Area

Agreement between the City of Bondurant, Polk County, Iowa, and Polk County, Iowa.  Roll Call:  Bailey-Yes, Cordes-Yes, Schiermeister-Yes, Kromrie-Yes, Valentine-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Schiermeister, to approve Resolution No. 05-38, a Resolution approving and requesting funding for Project 2-05 Bondurant Sewer.  Roll Call:   Cordes-Yes,  Schiermeister-Yes,   Bailey-Yes,   Kromrie-Yes,  Valentine-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Schiermeister, to approve Resolution No. 05-39, a Resolution approving the Utility Extension Agreement between the City of Bondurant, Polk County, Iowa, Polk County, Iowa, and Jerry’s Homes, Inc.  Roll Call: Bailey-Yes, Schiermeister-Yes, Kromrie-Yes, Cordes-Yes, Valentine-Yes.  Motion carried.

 

Bondurant Men’s Club Representative Jerry Pritchard, 502 – 11th Court, Southeast, requested the City serve as the Permit Holder for the Supervised Display of Fireworks for Summer Fest, 2005.

 

Motion made by Council Member Valentine, seconded by Council Member Schiermeister, to approve Resolution No. 05-40, a Resolution approving the Permit for Supervised Display of Fireworks for the City of Bondurant, Polk County, Iowa.  Roll Call:  Valentine-Yes, Schiermeister-Yes, Bailey-Yes, Kromrie-Yes, Cordes-Yes.  Motion carried.

 

Bondurant Emergency Services Chief Brian Poffenberger presented the Request for Proposal for a 2006 Model Attack Truck for the City of Bondurant and answered questions from the Mayor and Council Members.

 

Motion made by Council Member Cordes, seconded by Council Member Bailey, to approve Resolution No. 05-41, a Resolution approving the Request for Proposal for a 2006 Model Attack Truck for the City of Bondurant, Polk County, Iowa.  Roll Call:  Cordes-Yes, Bailey-Yes, Schiermeister-Abstain, Kromrie-Yes, Valentine-Yes.  Motion carried.  Council Member Bailey stated that if a Council Member plans to Abstain, it should be declared at the onset of the agenda item being discussed, and the Council Member should not be involved in said discussion.

 

Motion made by Council Member Bailey, seconded by Council Member Cordes, to approve Resolution No. 05-42, a Resolution approving the Job Descriptions for Building Inspector / Code Enforcement Officer and City Planner / Project Manager for the City of Bondurant, Polk County, Iowa.  Roll Call:  Bailey-Yes, Cordes-Yes, Schiermeister-Yes, Kromrie-Yes, Valentine-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Kromrie, to waive the second reading of Ordinance No. 05-205, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by amending provisions pertaining to Temporary Sign Permits – Private Property and Fee Schedule, and approve as the third and final reading.  Roll Call:  Bailey-Yes, Kromrie-Yes, Schiermeister-Yes, Cordes-Yes, Valentine-Yes.  Motion carried.

Motion made by Council Member Cordes, seconded by Council Member Kromrie, to close the regular City Council meeting and open Public Hearing to consider a request to re-zone a certain parcel of real estate from “A-1” Agricultural District to an “M-2” Medium Industrial District.  City Administrator Carlyle stated  the  re-zoning request is  for approximately  107.65 (+/-), located north of Northeast 78th Avenue

and east of U.S. Highway 65, Bondurant, Polk County, Iowa.  He said the re-zoning request has met the administrative review requirements, has been approved by the Planning and Zoning Commission and his office received no written or verbal comments.  No verbal comments were received during the public hearing.  Motion made by Council Member Bailey, seconded by Council Member Cordes, to close Public Hearing and open the regular City Council Meeting.  Roll Call:  Bailey-Yes, Cordes-Yes, Schiermeister-Yes, Kromrie-Yes, Valentine-Yes.  Motion carried.

 

Motion made by Council Member Kromrie, seconded by Council Member Cordes, to waive the first and second reading of Ordinance No. 05-206, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by amending the zoning classification of certain real estate from an “A-1” Agricultural District to an “M-2” Medium Industrial District, and approve as the third and final reading.  Roll Call:  Kromrie-Yes, Cordes-Yes, Bailey-Yes, Schiermeister-Yes, Valentine-Yes.  Motion carried.

ü      Referenced communication from The National Arbor Day Foundation regarding the City of Bondurant being named as 2004 Tree City USA and expressed appreciation to Ms. Rita Rostenbach for all of her continued efforts.

ü      Referenced The Greater Des Moines Partnership’s Quarterly Prospect Report.

ü      Referenced communication from Polk County Sheriff Dennis W. Anderson expressing his appreciation to Mayor Ihde and the City of Bondurant for their effort concerning the jail referendum.

ü      Referenced copies of an article recently published in the Des Moines Register pertaining to Polk County assessments.

ü      Referenced communication from 84 Lumber Company thanking City Administrator Carlyle for his assistance.

ü      Referenced communication from Mr. Ron Hamm thanking Bondurant Emergency Services for their help.

Mr. Leo Gaulke, 145 Patterson Street, Southeast, Bondurant, Iowa  voiced his dissatisfaction about the location that his neighbor is building his garage, causing water run-off onto his property.  Mayor Ihde informed him that this is a civil issue between him and his neighbor.

 

Motion made by Council Member Cordes, seconded by Council Member Bailey, to adjourn said meeting at 7:15 p.m.  Ayes:  5.  Nays:  0.  Motion carried.
