A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City Center on the 07th day of June, 2004, at 6:00 p.m.

 

 

Present:                Mayor Allen G. Ihde

                              Council Member Bruce N. Cordes                   

                              Council Member Jeffrey A. Kromrie

                              Council Member Gregory S. Schiermeister

Absent:                 Council Member Michele R. Bailey

Notice of the meeting was posted at the Bondurant City Center, Ampride Store, Casey’s General Store, and Legacy Bank on June 04th, 2004.  All proceedings hereafter shown were taken while the convened meeting was open to the public.

 

Mayor Ihde  called the meeting to  order at 6:00 p.m.  Roll  call  was  taken and a quorum was declared. 

 

Motion made by Council Member Kromrie, seconded by Council Member Schiermeister, to approve the agenda as presented.  Roll Call:  Kromrie-Yes,  Schiermeister-Yes, Cordes-Yes.  Motion carried.

 

David and Carla Nissen, 403 Deer Ridge Drive, Northwest, expressed concern regarding the recent overflow of water into their home and questioned the City’s water easement policy.  Mayor Ihde said the City is researching property lines and drainage easements in this area and are in the process of locating additional documents.  City Administrator Carlyle encouraged them to make contact with his office on Wednesday, June 09th.  He stated the Plat was approved according to the Urban Standards and the City of Bondurant Standards and Code had been followed.  Mayor Ihde added all of the cities in the metropolitan area have adopted the Urban Standards.  It addresses utility easements and every city follows the same standards.

 

Greg Jay, 301 – 11th Street, Southeast voiced dissatisfaction of a neighbor’s tall grass and weeds.  City Administrator Carlyle said that mowing complaints are addressed by the Polk County Weed Commission.  Polk County’s policy is that after receiving a complaint,  they send a notice of non-compliance to the property owner, which gives them approximately five days to comply, or Polk County staff will mow the property and assess all costs to the property owner’s taxes.  He advised calling Polk County Weed Commission again and inquire as to the time frame of the notice.

Leslie Quarve, 302 – 11th Street, Southeast expressed her displeasure about the two-tone color of a neighbor’s house.  Mayor Ihde stated that the City has no control over the color a homeowner chooses to paint their house.

 

Kathy Clayton, 120 – 5th Street, Northeast requested speed limit signs and / or a “Children at Play” sign on Lincoln Street, Northeast to try and slow down the speed on Lincoln Street, Northeast and 5th Street, Northeast.  City Administrator Carlyle stated that City Code addresses speed signs but a “Children at Play” sign would require  Council  action.  Mayor Ihde  asked  Polk  County  Deputy Mohr to watch the area  closer  and the sign request will be put on the June 21, 2004, agenda.     

 

Rick Erickson, 102 – 2nd Street, Northwest asked if City Code addresses emergency spillway.  City Administrator Carlyle stated it is being researched now.

 

Motion made by Council Member Cordes, seconded by Council Member Schiermeister, to approve the consent items consisting of the City Council Minutes of May 17, 2004, WRA Management Agency Minutes of May 18, 2004, Des Moines Area MPO Minutes of April 15, 2004, Metro Waste Authority Minutes of March 17, 2004, Bondurant Municipal Facility Committee Minutes of May 26, 2004, the Claims Report and Tax Abatement applications for Tim and Rebecca Hughes, 102 – 5th Street, Northeast and Chad and Sherri Carlson, 603 – 6th Court, Northwest, Bondurant, Polk County, Iowa.  Roll Call:  Cordes-Yes, Schiermeister-Yes, Kromrie-Yes.  Motion carried.

 

Polk County Sheriff’s Department Representative Deputy Mark Mohr had nothing to report.

 

Polk County Supervisor Tom Hockensmith updated Council on Polk County Government.  The update included the new water / sewer policy; enforcement of the nuisance abatement; budget; Polk County Convention Center; new jail task force; balanced growth and the Iowa Events Center.

 

Motion made by Council Member Kromrie, seconded by Council Member Cordes, to approve Resolution No. 04-55, a Resolution approving the street closure of Lincoln Street, Northeast on June 26, 2004, from 4:00 p.m. to 9:00 p.m. for a neighborhood block party.  Roll Call:  Kromrie-Yes, Cordes-Yes, Schiermeister-Yes.  Motion carried.

 

Wally Pelds, Project Manager, A. Leo Pelds Engineering Company, 1372 East 12th Street, Des Moines, presented the Site Plan for the Quizno’s Development.

 

Motion made by Council Member Cordes, seconded by Council Member Schiermeister, to approve Resolution No. 04-56, a Resolution approving the Site Plan for the Quizno’s Development, 119 Brick Street, Southeast (or 1204 Oleson Drive, Southeast), Bondurant, Polk County, Iowa.  Roll Call:  Cordes-Yes, Schiermeister-Yes, Kromrie-Yes.  Motion carried.

 

Motion made by Council Member Schiermeister, seconded by Council Member Kromrie, to approve Resolution No. 04-57, a Resolution approving Iowa Retail Cigarette Permit for Singh’s Self Service, 1111 Lincoln Street, Southeast, Bondurant, Polk County, Iowa.  Roll Call:  Schiermeister-Yes, Kromrie-Yes, Cordes-Yes.  Motion carried.

City Administrator Carlyle explained that the City of Bondurant has gone through a series of studies with the Iowa Department of Transportation and our traffic control signs were inventoried.  The City has been awarded  approximately  $5,000.00  of  signing  materials  from  the Iowa Department of Transportation.

 

Motion made by Council Member Kromrie, seconded by Council Member Cordes, to approve Resolution No. 04-58, a Resolution directing the Mayor to Order Traffic Control Signing Materials from the Iowa Department of Transportation.  Roll Call:  Kromrie-Yes, Cordes-Yes, Schiermeister-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Schiermeister, to approve Resolution 04-59, a Resolution approving the Des Moines Area MPO’s Fiscal Year 2005 Unified Planning Work Program Budget for the period July 01, 2004 to June 30, 2005.  Roll Call:  Cordes-Yes, Schiermeister-Yes, Kromrie-Yes.  Motion carried.

 

Motion made by Council Member Kromrie, seconded by Council Member Schiermeister, to approve Resolution No. 04-60, a Resolution approving Iowa Retail Cigarette Permit for Cenex – Ampride, 6175 Henry Street, Southwest, Bondurant, Polk County, Iowa.  Roll Call:  Kromrie-Yes, Schiermeister-Yes, Cordes-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Schiermeister, to approve Resolution No. 04-61, a Resolution approving the first meeting date in the month of July to be July 06, 2004.  Roll Call:  Cordes-Yes, Schiermeister-Yes, Kromrie-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Schiermeister, to approve the second reading of Ordinance No. 04-206, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by amending provisions pertaining to Special Speed Restrictions.  Roll Call:  Cordes-Yes, Schiermeister-Yes, Kromrie-Yes.  Motion carried.

 

The following item(s) were discussed as part of Mayor Ihde’s comments:

 

·        Update on his Washington D.C. trip.

·        Inquired about drop-off sites for large quantities of cardboard.

 

Fire Chief Brian Poffenberger stated that the number of calls on  Bondurant Emergency Services Report for May, 2004, should be increased by one.

q       Council Member Cordes – Thanked Bondurant Emergency Services for their assistance with the fireworks display during Summerfest and City Administrator Carlyle and City Staff for their help with Summerfest preparations.

 

Motion made by Council Member Kromrie, seconded by Council Member Cordes, to adjourn said meeting at 7:09 p.m.  Ayes:  3.  Nays:  0.  Motion carried.
