A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City Center on the 19th day of May, 2003, at 6:00 p.m.

Notice of the meeting was posted at the Bondurant City Center, Ampride Store, Casey’s General Store, and Legacy Bank on May 16, 2003. All proceedings hereafter shown were taken while the convened meeting was open to the public.

Mayor Ihde called the meeting to order at 6:00 p.m. Roll call was taken and a quorum was declared.

Motion made by Council Member Williams, seconded by Council Member Valentine, to approve the agenda as presented. Roll Call: Williams-Yes, Valentine-Yes, Cordes-Yes, Thomas-Yes, Bailey-Yes. Motion carried.

Motion made by Council Member Cordes, seconded by Council Member Thomas, to approve the consent items consisting of the City Council Minutes of May 05, 2003, Polk County Aviation Authority Minutes of April 10, 2003, Planning and Zoning Commission Minutes of April 10, 2003, Emergency Management Commission Minutes of May 06, 2003, Des Moines Area MPO Minutes of April 17, 2003, WRA Management Agency Minutes of March 25, 2003, WRA Management Agency Minutes of April 15, 2003, the Claims Report and Financial Reports and Tax Abatement Application for Dennis Lyman and Stacey Keller, 809 Filmore Avenue, Southeast, Bondurant, Polk County, Iowa. Roll Call: Cordes-Yes, Thomas-Yes, Williams-Yes, Valentine-Yes, Bailey-Yes. Motion carried.

Polk County Sheriff’s Department Representative Lt. Jorgenson was present and had nothing to report.

Mayor Ihde led a lengthy discussion regarding parking problems that occurred during the City – Wide Garage Sale. Council requested the subject be put on the June 02, 2003, City Council Meeting Agenda.

Motion made by Council Member Williams, seconded by Council Member Bailey, to approve Resolution No. 03-55, a Resolution authorizing and directing the City Administrator to Write – Off certain Emergency Medical Service Accounts as Non – Collectible. Roll Call: Williams-Yes, Bailey-Yes, Thomas-Yes, Cordes-Yes, Valentine-Yes. Motion carried.

Motion made by Council Member Bailey, seconded by Council Member Valentine, to approve Resolution No. 03-56, a Resolution authorizing the closure of certain streets within the City of Bondurant, Polk County, Iowa, for Summer Fest, 2003. The streets that will be closed are as follows: Main Street, Southeast, from Railroad Street, Southeast, to Second Street, Southeast; and First Street, Southeast, from Grant Street, South, to the alley between Main Street, Southeast, and Lincoln Street, Southeast; and Second Street, Southeast, from the alley between Grant Street, South, and Main Street, Southeast, to the alley between Main Street, Southeast, and Lincoln Street, Southeast, from June 15, 2003, at 12:00 noon to June 18, 2003, at 8:00 a.m. Roll Call: Bailey-Yes, Valentine-Yes, Thomas-Yes, Williams-Yes, Cordes-Yes. Motion carried.

Motion made by Council Member Thomas, seconded by Council Member Bailey, to approve Resolution No. 03-57, a Resolution approving the Iowa Retail Cigarette Permit(s) for Casey’s General Store #1373, 302 – 2nd Street, Northeast, and Casey’s General Store #1861, 1455 Grant Street, South, Bondurant, Polk County, Iowa. Roll Call: Thomas-Yes, Bailey-Yes, Williams-Yes, Cordes-Yes, Valentine-Yes. Motion carried.

Motion made by Council Member Valentine, seconded by Council Member Cordes, to approve Resolution No. 03-58, a Resolution re-scheduling the Bondurant City Council meeting for the second meeting in June, 2003, to Monday, June 23, 2003. Roll Call: Valentine-Yes, Cordes-Yes, Williams-Yes, Bailey-Yes, Thomas-Yes. Motion carried.

City Administrator Carlyle informed Council that the Iowa Department of Transportation Audit Department requested a reduction in labor rates and a minor change in direct costs regarding the Professional Services Agreement between the City of Bondurant, Stanley Consultants, Inc., and the State of Iowa, relating to the Northeast 62nd Avenue Bridge Replacement Project.

Motion made by Council Member Williams, seconded by Council Member Bailey, to approve Resolution No. 03-59, a Resolution approving Amendment No. 01 to the Professional Service Agreement between the City of Bondurant, Stanley Consultants, Inc., and the State of Iowa, relating to the Northeast 62nd Avenue Bridge Replacement Project. Roll Call: Williams-Yes, Bailey-Yes, Cordes-Yes, Valentine-Yes, Thomas-Yes. Motion carried.

Motion made by Council Member Williams, seconded by Council Member Cordes, to approve the first reading of Ordinance No. 03-213, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 2002, by amending and adding provisions pertaining to Load Limits upon Certain Streets, Truck Routes within the Corporate Limits and a Penalty Provision, but amending Section 66.05, Truck Route, Paragraph A – Truck Routes Designated to include the following: U.S. Highway 65 and Grant Street, South, from Interstate 80 North to U.S. Highway 65. Roll Call: Williams-Yes, Cordes-Yes, Bailey-Yes, Thomas-Yes, Valentine-Yes. Motion carried.
