Meeting No. 02-20
A regular meeting of the City Council of the City of
Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant
City Center on the 16th day of September, 2002, at 6:00 p.m.

Notice of the meeting was posted at the Bondurant City Center, Ampride Store, Casey’s General Store, and Legacy Bank on September 13th, 2002. All proceedings hereafter shown were taken while the convened meeting was open to the public.
Mayor Ihde called the meeting to order at 6:00 p.m. Roll call was taken and a quorum was
declared.
Motion made by Council Member Bailey, seconded by Council
Member Williams, to approve the agenda as presented. Roll Call: Bailey-Yes,
Williams-Yes, Thomas-Yes, Valentine-Yes.
Motion carried.
Mr. Pat George of GTL Transportation, 250 Prairie Drive,
Southwest, Bondurant, Iowa, and Mr. Jerry Bishop, 4050 Northeast 78th Avenue,
Ankeny, Iowa, addressed Council regarding an adjacent property retention
pond. City Attorney Brick and City
Administrator Carlyle advised both parties that this is a civil issue between
the property owners involved.
Ms. Roseanne Bell, 502 Brick Street, Southeast, spoke before
the Council concerning a lack of response concerning a complaint against her
neighbor who is welding inside his garage.
City Administrator responded to her.
Motion made by Council Member Bailey, seconded by Council
Member Thomas, to approve the consent items consisting of the City Council
Minutes of September 03, 2002, Polk County Aviation Minutes of August 08, 2002,
the Claims Report and Financial Reports.

Polk County Sheriff’s Department Representative Lt.
Jorgensen reported that due to speed control continuing to be enforced, the
number of tickets being written has decreased.
Motion by Council Member Williams, seconded by Council
Member Bailey, to close the regular City Council meeting and open Public
Hearing to consider a Request for Re-Zoning from C-2 and A-1 to U-1,
C-2, R-2 and R-3, on a 96.69
acre parcel of land
located along the
east side of U.S. Highway 65, north of Northeast 70th
Avenue, Bondurant, Polk County, Iowa.

Motion carried. Mr. Eric
Gjersvik, P.E., provided the Council with an overview of the 96.69 acres of the
Clarence Oleson Vista Estates (the C.O.V.E.), located long the east side of
U.S. Highway 65, north of Northeast 70th Avenue. City Administrator
Carlyle reported no verbal or written comments have been received by his
office. No verbal comments were
received during the public hearing.
Motion made by Council Member Thomas, seconded by Council Member
Valentine, to close Public Hearing and open the regular City Council
Meeting. Roll Call: Thomas-Yes, Valentine-Yes, Bailey-Yes,
Williams-Yes. Motion carried.
Motion made by Council Member Williams, to waive the first
and second reading of Ordinance No. 02-206, an Ordinance amending the Official
Zoning Map of the City of Bondurant, Polk County, Iowa, and approve said
Ordinance as the third and final reading.
Motion failed due to a lack of a second to the motion.
Motion made by Council Member Bailey, seconded by Council
Member Thomas, to approve the first reading of Ordinance No. 02-206, an
Ordinance amending the Official Zoning Map of the City of Bondurant, Polk
County, Iowa. Roll Call: Bailey-Yes, Thomas-Yes, Williams-Yes,
Valentine-Yes. Motion carried. The second reading of Ordinance No. 02-206
was scheduled for October 07, 2002.
Ms. Rosanne Bell, 502 Brick Street, Southeast, spoke before
the Council concerning a previous written communication issued to the Mayor /
Council and that the background facts were inaccurately written and provided
the Council her written suggestions for Ordinance No. 02-205, an Ordinance
amending the Code of Ordinances of the City of Bondurant, Polk County, Iowa,
2002, by adding a Section pertaining to the Limitation On Parking for Specified
Vehicles and providing Exceptions thereof.
Motion made by Council Member Bailey, seconded by Council
Member Williams, to approve the first reading of Ordinance No. 02-205, an
Ordinance amending the Code of Ordinances of the City of Bondurant, Polk
County, Iowa, 2002, by adding a Section pertaining to Limitation on
parking-Specified Vehicles and providing Exceptions thereof, and to include a
second Exception that would read: Any
moving truck, while being used for the sole purpose of relocating a person’s
residence, has a period of 48 hours in which it may be parked on public streets
without application for a permit. Roll

Motion made by Council Member Thomas, seconded by Council
Member Williams, to approve Resolution No. 02-89, a Resolution declaring
“Beggars Night” within the corporate limits of the City of Bondurant, Polk
County, Iowa, on Wednesday, October 30, 2002, between the hours of 6:00 p.m.
and 8:00 p.m. Roll Call: Thomas-Yes, Williams-Yes, Bailey-Yes,
