A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City Center on the 20th day of May, 2002, at 6:00 p.m.

Notice of the meeting was posted at the Bondurant City Center, Ampride Store, Casey’s General Store, and Legacy Bank on May 17, 2002.  All proceedings hereafter shown were taken while the convened meeting was open to the public.

 

Mayor Ihde called the meeting to order at 6:00 p.m.  Roll call was taken and a quorum was declared.

 

Motion made by Council Member Williams, seconded by Council Member Valentine, to approve the agenda as presented.  Roll call:  Ayes:  5.  Nays:  0.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Cordes, to approve the consent items consisting of the City Council Minutes of May 06, 2002, Bondurant Community Library Minutes of April 04, 2002, Des Moines Area MPO Minutes of April 18, 2002, Metro Waste Authority Minutes of March 27, 2002, the Claims Report, Financial Reports, Tax Abatement Application for Joe C. Stoltz, 307 Third Street, Northwest, Bondurant, Polk County, Iowa and Acknowledge / Settlement Agreement for Casey’s General Store #1373.  Roll Call:  Bailey-Yes, Cordes-Yes, Williams-Yes, Thomas-Yes, Valentine-Yes.  Motion carried.

 

Polk County Sheriff’s Department Representative Lt. Jorgenson had nothing to report.

County, Iowa, Municipal FY 2001 / 2002 Budget.  Roll Call:  Thomas-Yes, Valentine-Yes, Bailey-Yes, Williams-Yes, Cordes-Yes.  Motion carried.  City Administrator Carlyle reported no written or verbal comments were  received by his office.  No verbal comments  were received during  the Public Hearing.

 

Motion made by Council Member Cordes, seconded by Council Member Thomas, to close Public Hearing and open the regular City Council meeting.  Roll Call:  Cordes-Yes, Thomas-Yes, Bailey-Yes, Williams-Yes, Valentine-Yes.  Motion carried.

 

Motion made by Council Member Williams, seconded by Council Member Valentine, to approve Resolution No. 02-59, a Resolution approving the amended FY 2001 / 2002 Municipal Budget for the City of Bondurant, Polk County, Iowa.  Roll Call:  Williams-Yes, Valentine-Yes, Bailey-Yes, Thomas-Yes, Cordes-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Cordes, to approve Resolution No. 02-60, a Resolution re-scheduling the regular City Council meeting from June 17, 2002, to June 19, 2002 at 6:00 p.m.  Roll Call:  Bailey-Yes, Cordes-Yes, Williams-Yes, Thomas-Yes, Valentine-Yes.  Motion carried.

 

Motion made by Council Member Thomas, seconded by Council Member Bailey, to approve Resolution No. 02-61, a Resolution approving the Iowa Retail Cigarette Permit(s) for Casey’s General Store #1373, 302 Second Street, Northeast and Casey’s General Store #1861, 1455 Grant Street, South, Bondurant, Polk County, Iowa.  Roll Call:  Thomas-Yes, Bailey-Yes, Williams-Yes, Cordes-Yes, Valentine-Yes.  Motion carried.

 

Metro Waste Authority Business Development Manager Elizabeth A. Shonts presented the Solid Waste Reduction Comprehensive Plan to Council. 

 

Motion made by Council Member Williams, seconded by Council Member Bailey, to approve Resolution No. 02-62, a Resolution approving the Comprehensive Solid Waste Reduction Plan.  Roll Call:  Williams-Yes, Bailey-Yes, Thomas-Yes, Cordes-Yes, Valentine-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Valentine, to approve Resolution No. 02-63, a Resolution granting permission to the Bondurant Men’s Club to close the following streets and intersections from June 15, 2002 at 6:00 p.m. to June 19, 2002 at 9:00 a.m. for the Bondurant Summerfest:  Main Street, Southeast from Railroad Street, Southeast to Second Street, Southeast and First Street, Southeast from Grant Street, South to Lincoln Street, Southeast.  Roll Call:  Bailey-Yes, Valentine-Yes, Williams-Yes, Thomas-Yes, Cordes-Yes.  Motion carried.

ü      Informed Council that Sandra Rhodes had received a scholarship to the Iowa Municipal Clerk’s Institute from the Golden Circle of Municipal Officers Association.

ü      Informed Council of MidAmerican donation in the amount of $1,000.00 to Bondurant Trees Forever.

Bondurant Fire Chief Brian Poffenberger demonstrated the Fire Department’s new air bottles.

 

Motion by Council Member Valentine, seconded by Council Member Cordes, to recess at 6:40 p.m.  Roll Call:  Valentine-Yes, Cordes-Yes, Bailey-Yes, Williams-Yes, Thomas-Yes.  Motion carried.

 

Council Member Bailey left at 6:52 p.m.

 

Council reconvened at 7:00 p.m.

 

Mayor Ihde opened the Hearing Complaint of which Iowa Code Section 453A.2(1) provides that a person shall not “sell, give, or otherwise supply any tobacco, tobacco products or cigarettes to any person under eighteen years of age.”  2.  Iowa Code Section 453A.22(2)(a) provides that if a permit holder or employee of a permit holder has violated Iowa Code Section 453A.2(1), the permit holder shall be assessed a civil penalty of three hundred dollars ($300.00) for a first violation of Iowa Code Section 453A.2(1).  3.  On or about March 22, 2001, the permittee or an employee of the permittee sold cigarettes or tobacco products to a person under eighteen years of age.  A copy of the Compliance Check or Criminal Conviction is attached and incorporated herein.  4.  Therefore, in accordance with Iowa law, the City of Bondurant requests the Bondurant City Council find a violation of the above-referenced sections of Iowa Code Chapter 453A and assess a civil penalty in the amount of three hundred dollars ($300.00) against Amarjit Singh, d/b/a Singh’s Self Service IV, 1111 Lincoln Street, Southeast, Bondurant, Iowa, 50035.  Amarijit Singh, d/b/a Singh’s Self Service IV failed to appear for said hearing.

 

Motion by Council Member Williams, seconded by Council Member Cordes, to assess a civil penalty of three hundred dollars to Amarjit Singh, d/b/a Singh’s Self Service, IV, 1111 Lincoln Street, Southeast,

Bondurant, Polk County, Iowa.  Roll Call:  Williams-Yes, Cordes-Yes, Thomas-Yes, Valentine-Yes.  Motion carried.
