A regular meeting of the City Council of the City of Bondurant,
Polk County, Iowa, was held in the Community Room at the Bondurant City Center
on the 20th day of May, 2002, at 6:00 p.m.

Notice of the meeting was posted at the Bondurant City
Center, Ampride Store, Casey’s General Store, and Legacy Bank on May 17,
2002. All proceedings hereafter shown
were taken while the convened meeting was open to the public.
Mayor Ihde called the meeting to order at 6:00 p.m. Roll call was taken and a quorum was
declared.
Motion made by Council Member Williams, seconded by Council
Member Valentine, to approve the agenda as presented. Roll call: Ayes: 5.

Member Cordes, to approve the consent items consisting of the City Council

Member Valentine, to approve Resolution No. 02-59, a Resolution approving the
amended FY 2001 / 2002 Municipal Budget for the City of Bondurant, Polk County,
Iowa. Roll Call: Williams-Yes, Valentine-Yes, Bailey-Yes,
Thomas-Yes, Cordes-Yes. Motion carried.

Member Cordes, to approve Resolution No. 02-60, a Resolution re-scheduling the
regular City Council meeting from June 17, 2002, to June 19, 2002 at 6:00

Valentine-Yes. Motion carried.

Member Bailey, to approve Resolution No. 02-61, a Resolution approving the Iowa

A. Shonts presented the Solid Waste Reduction Comprehensive Plan to
Council.

Member Bailey, to approve Resolution No. 02-62, a Resolution approving the
Comprehensive Solid Waste Reduction Plan.

intersections from June 15, 2002 at 6:00 p.m. to June 19, 2002 at 9:00 a.m. for
the Bondurant Summerfest: Main Street,
Southeast from Railroad Street, Southeast to Second Street, Southeast and First
Street, Southeast from Grant Street, South to Lincoln Street, Southeast. Roll Call:

Council reconvened at 7:00 p.m.
Mayor Ihde opened the Hearing Complaint of which Iowa Code
Section 453A.2(1) provides that a person shall not “sell, give, or otherwise
supply any tobacco, tobacco products or cigarettes to any person under eighteen
years of age.” 2. Iowa Code Section 453A.22(2)(a) provides
that if a permit holder or employee of a permit holder has violated Iowa Code
Section 453A.2(1), the permit holder shall be assessed a civil penalty of three
hundred dollars ($300.00) for a first violation of Iowa Code Section
453A.2(1). 3. On or about March 22, 2001, the permittee or an employee of the
permittee sold cigarettes or tobacco products to a person under eighteen years
of age. A copy of the Compliance Check
or Criminal Conviction is attached and incorporated herein. 4.
Therefore, in accordance with Iowa law, the City of Bondurant requests
the Bondurant City Council find a violation of the above-referenced sections of
Iowa Code Chapter 453A and assess a civil penalty in the amount of three
hundred dollars ($300.00) against Amarjit Singh, d/b/a Singh’s Self Service IV,
1111 Lincoln Street, Southeast, Bondurant, Iowa, 50035. Amarijit Singh, d/b/a Singh’s Self Service
IV failed to appear for said hearing.

Member Cordes, to assess a civil penalty of three hundred dollars to Amarjit
Singh, d/b/a Singh’s Self Service, IV, 1111 Lincoln Street, Southeast,
Bondurant, Polk County, Iowa. Roll Call: Williams-Yes,
Cordes-Yes, Thomas-Yes, Valentine-Yes.
