A regular meeting of the City Council of the City of
Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant
City Center on the 19th day of November, 2001, at 7:00 p.m.

Notice of the meeting was posted at the Bondurant City Center, Ampride Store, Casey’s General Store, and Legacy Bank on November 16, 2001. All proceedings hereafter shown were taken while the convened meeting was open to the public.
Mayor Ihde called the meeting to order at 7:00 p.m. Roll call was taken and a quorum was declared.
Motion made by Council Member Cordes, seconded by Council Member Valentine, to approve the agenda as presented. Roll call: Ayes: 5. Nays: 0. Motion carried.
Motion made by Council Member Bailey, seconded by Council Member Thomas, to approve the consent items consisting of the City Council Minutes of November 05, 2001, Polk County Emergency Commission Minutes of October 25, 2001, Polk County Aviation Authority Minutes of October 04, 2001, Des Moines Area MPO Minutes of October 18, 2001, Claims Report and Financial Reports. Roll Call: Bailey-Yes, Thomas-Yes, Cordes-Yes, Williams-Yes, Valentine-Yes. Motion carried.
Polk County Sheriff’s Department Representative Lt. Jorgenson presented no report.
Mayor Ihde gave an overview to Council pertaining to a meeting on November 16th, between the City of Bondurant, Polk County and the Iowa Department of Transportation regarding the Intersection of U.S. Highway 65 and Iowa Highway 945.
Iowa Department of Transportation District 1 Engineer Scott A. Dockstader, P.E. updated the Council regarding the Intersection of U.S. Highway 65 and Iowa Highway 945 (Grant Street, South). Mr. Dockstader highlighted the Iowa Department of Transportation’s plans and answered questions from residents. He stated that the department has painted the medians. He recommended the following: to

immediately begin developing interchange design options including but not limited to offset turn lanes, post additional signage on U.S. highway 65 north and south of intersection indicating an upcoming intersection, and increase enforcement of the speed limit on U.S. Highway 65, which currently 80 percent of the traffic is traveling 65 mph in this 55 mph zone. The department will move forward with interim improvements, and if accidents continue they will be in a position to move forward with traffic signals.
Council Member Cordes asked Mr. Dockstader to comment on rumors. Mr. Dockstader stated that the City of Bondurant has always wanted signalization at the Intersection of U.S. Highway 65 and Iowa Highway 945 and at no time did the City decline to participate financially; and that the Iowa Department of Transportation did not manipulate the report authored by Stanley Consultants, Inc.
Resident Lisa Schiermeister, 7228 NE 80th Street, inquired as to the possibility of reducing the speed limit. Resident Jeff Kromrie, 908 Lincoln Street, Southeast, asked why the Iowa Department of Transportation doesn’t recognize that said Intersection runs through the middle of the city due to new development, did Altoona have to go through the same steps as Bondurant for the light by Menard’s, if residents call for an update will they get hung up on. Resident Linda Wunn, 105 Lincoln Street, Southeast, stated there has been enough study and it’s time to install a traffic light, who can residents call for an update.
Resident Tyler McIntosh, 200 - 7th Court, Southeast, questioned whether each Council Member was committed to a signalized intersection. Unidentified resident asked how the new Menard’s in Altoona got a traffic light. Unidentified resident asked if the Iowa Department of Transportation was agreeing to a traffic light. Unidentified resident asked if there will be a light where Ziegler is going in after they widen the highway.
Business owner Sue Ugulini, addressed visibility in the median, the area is too small for a school bus or tractor, on south side of intersection there is an aspect of traffic that is uncontrolled. Resident Ray Sauer, 515 – 10th Court, Southeast, stated that in the area of Granger the speed drops from 65 to 55 mph. Resident Dan Fogarty, 6525 NE 88th Street, wanted a yes or no if there would eventually be a traffic light at said Intersection, how many signs will be up and down the highway. Resident Randy Duffy, 502 Lincoln Street, Southeast, inquired about the criteria during the Department’s six month study, why was the ball dropped in 1994, are the twelve warrants in report, what number needs to happen in the next six months relating to accidents to proceed with traffic light installation.
Unidentified resident asked what the twelve warrants were. Mike Ugulini, 6475 NE 80th Street, asked what time of day speed study was done. Resident Mike Adams, Sr., 94 Grant Street, North, asked if traffic light will be installed by next year, one of the problems is speed enforcement and are Polk County’s patrol hours limited. Unidentified resident asked if when the diagonal is finished won’t the average speed increase, need a speed limit reduction sign and a light together.
Resident Jennifer McIntosh, 200 – 7th Court, Southeast, asked what date flashing lights would be installed.
Bondurant Fire Chief Brian Poffenberger stated that he hoped the Council was behind the department as they are physically and emotionally drained.

Council Member Williams suggested a recess at 8:22 p.m. Meeting resumed at 8:39 p.m.
Mayor Ihde highlighted the changes in the Employment Contract and Agreement between the City of Bondurant and City Administrator Darrel Steven Carlyle. Council Member Cordes stated that the sub-committee appointed by Mayor Ihde to review the contract supported the changes.
Motion by Council Member Cordes, seconded by Council Member Thomas, to approve Resolution No. 01-118, a Resolution approving the Employment Contract and Agreement between the City of Bondurant and City Administrator Darrel Steven Carlyle. Roll Call: Cordes-Yes, Thomas-Yes, Bailey-Yes, Williams-Yes, Valentine-Yes. Motion carried.
City Administrator Carlyle reported to Council that the annual Financial Report for the Department of Management is due by December 01, 2001. Poock and Siebke will be attending the Council Meeting on December 03, 2001 to present audit.
Motion by Council Member Bailey, seconded by Council member Valentine, to approve Resolution No. 01-119, a Resolution approving the City of Bondurant 2001 Financial Report for the Fiscal year ended June 30, 2001. Roll Call: Bailey-Yes, Valentine-Yes, Williams-Yes, Thomas-Yes, Valentine-Yes. Motion carried.
Motion by Council Member Williams, seconded by Council Member Thomas, to approve Resolution No. 01-120, a Resolution approving the Invoice from Watertower Demolition Company, in the amount of $17,300.00, pertaining to the removal of the Bondurant watertower. Roll Call: Williams-Yes, Thomas-Yes, Bailey-Yes, Cordes-Yes, Valentine-Yes. Motion carried.
Motion by Council Member Thomas, seconded by Council Member Cordes, to approve Resolution No. 01-121, a Resolution accepting the Polk County Board of Canvassers’ Abstract of Election. Roll Call: Thomas-Yes, Cordes-Yes, Bailey-Yes, Williams-Yes, Valentine-Yes. Motion carried.
Mayor Ihde presented Certificates of Election to himself and to re-elected Council Members Michele R. Bailey and James M. Valentine.
Mayor Ihde and City Attorney Brick informed the Council of the recent events concerning the property at 100 Prairie Drive, Southwest.
Motion by Council Member Cordes, seconded by Council Member Thomas, to approve Resolution No. 01-122, a Resolution directing the City Attorney to undertake such action as necessary to seek enforcement of prior judgement by the Iowa District Court for Polk County and any and all actions necessary to bring the property at 100 Prairie Drive, Southwest, into compliance with zoning ordinances. Roll Call: Cordes-Yes, Thomas-Yes, Bailey-Yes, William-Yes, Valentine-Yes. Motion carried.

ü Informed Council that Chateau Communities has developed a new entity for Wolf Creek called “National Development Communities”.
ü Informed Council that City Attorney Brick has drawn up an agreement between the City of Bondurant, City of Altoona and Mr. and Mrs. Charles Lathrum regarding water services and said agreement has been forwarded to the City of Altoona.
ü Informed the Board of Trustees that he had received the first proposal to enact the study pertaining to Drainage District #30.
