NOTICE IS HEREBY GIVEN that a Special Meeting of the City Council will be held at 8:00 p.m. on Thursday, April 26, 2001, in the Community Room at Bondurant City Center at 200 Second Street, Northeast, Bondurant, Polk County, Iowa.  Said meeting is open and the public is encouraged to attend.

Meeting No. 01-09

 

A special meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City Center on the 26th day of April, 2001, at 8:00 p.m.

 

Present:                Mayor Allen G. Ihde

Notice of the special meeting was posted at the Bondurant City Center, Ampride Store, Casey’s General Store, and Farmers Savings Bank on April 24, 2001.  All proceedings here after shown were taken while the convened special meeting was open to the public.

 

Mayor Ihde called the special meeting to order at 8:45 p.m.  Roll call was taken and a quorum was declared. 

 

Motion made by Council Member Valentine, seconded by Council Member Williams, to approve the agenda as presented.  Roll Call: Valentine-Yes, Williams-Yes, Cordes-Yes, Thomas-Yes, Bailey-Yes.  Motion carried.

 

Mayor Ihde asked the Council Members to consider the presentation made by Iowa Network Services, Inc. Representative Merle Hoppenworth, pertaining to the Site Plan, during the previous Planning and Zoning Commission meeting.  There were no additional questions.

 

Motion made by Council Member Bailey, seconded by Council Member Valentine, to approve Resolution No. 01-44, a Resolution approving the Site Plan for Iowa Network Services, Inc.   Roll Call: Bailey-Yes, Valentine-Yes, Cordes-Yes, Thomas-Yes, Williams-Yes.  Motion carried.

 

Mayor Ihde asked the Council Members for additional comments regarding the presentation made by Chateau Communities, Inc. President Wally Moreland on the proposed Development Agreement between the City of Bondurant and Chateau Communities, Inc. during the previous Planning and Zoning Commission meeting. 

 

Council Member comments included: definition of lamp posts, metered sewer, bulk water usage rate, remove wording from agreement regarding number of students per housing unit, attached garages, sidewalks, sale of homes, lease fees, width of entrance roads, address illegal activity, single or double garages,   parking  for   recreation   vehicles,   responsibility   for  snow  removal   and   grass   mowing,

requirements to construct shed, arrangements for garbage removal, and summary of changes to development agreement.

 

Marvin Skinner. 1007 Grant Street, South, Bondurant, asked about the minimum square footage of the homes.

 

Mayor Ihde comments included: number of units double wide, add wording to agreement regarding the width of homes in the future, plan for homeowners that neglect leased lot, steps in place to evict homeowner if necessary, sixty (60) percent of homes will have garages and developer will pay impact fee to City of Bondurant until percentage met, Phase 1 considered complete, and remove wording from agreement regarding number of students per housing unit.

 

City Attorney Steven P. Brick comments included: asked for changes to agreement, remove reference to lamp posts, provide language in reference to metered sewer, clarify constructed versus occupied, and future might need reference to number of students per housing unit but for now unable to enforce unless change in legislation action.

   

City Administrator Carlyle comments included: developers cost, published rate for water and sewer, impact fee, performance bond, and sixty (60) percent of homes will have a garage and twenty (20) percent of remaining forty (40) percent will have a front door facing the street.   

 

Chateau Communities, Inc. President Wally Moreland responses included: street lights rather than lamp posts, siding on home will come down as low as possible with metal or stone sheeting at the bottom of home to give the appearance of a foundation, no skirting on the homes, homes can be sold by owner or use realtor of choice, potential buyers of home need to make application for lease, Chateau wants to control lease agreement and fee, most community homes will be multi-sectioned due to demand and market, single section defined as sixteen (16) feet wide, community covenant and lease will force clean-up of property if not Chateau will clean property and charge tenant, follow landlord and tenant laws, when eighty-five (85) percent of Phase 1 complete will begin Phase 2, provide area for recreation vehicles, will promote garage, and strict guidelines without garage.

 

Motion made by Council Member Cordes, seconded by Council Member Bailey, to approve Resolution No. 01-45, a Resolution approving the proposed Development Agreement between the City of Bondurant, Polk County, Iowa and Chateau Communities, Inc. relating to the Wolf Creek Development Project, as presented to the City Council, with revisions read into the record prior to the institution of discussion as well as those changes made through discussion.  Roll Call: Cordes-Yes, Bailey-Yes, Valentine-Yes, Thomas-No, Williams-Yes.  Motion carried.

 

Mayor Ihde asked the Council Members for additional comments regarding the presentation made by Chateau Communities, Inc., on the Site Plan, for Chateau at Wolf Creek during the previous Planning and Zoning Commission meeting.

 

The Council Member comment included: average lot size.

 

Chateau Communities, Inc. President Wally Moreland response included: lot sizes will be 55 feet x 110 feet.

Motion made by Council Member Williams, seconded by Council Member Bailey, to approve Resolution

No. 01-46, a Resolution approving the Site Plan for Chateau at Wolf Creek.  Roll Call: Williams-Yes, Bailey-Yes, Valentine-Yes, Cordes-Yes, Thomas-No.  Motion carried.

 

Mayor Ihde asked the Council Members for comments regarding Ordinance No. 01-203.  An Ordinance amending provisions pertaining to one way traffic within the corporate city limits of the City of Bondurant. 

 

Council Member comments included: letter mailing to parents describing one way traffic rules should have been distributed after council approval, will communicate to school awkward situation for Council, and school will reimburse City of Bondurant for signage.

 

Motion made by Council Member Bailey, seconded by Council Member Cordes, to suspend the first and second reading of Ordinance No. 01-203 and to approve Ordinance No. 01-203, an Ordinance amending the Code of Ordinances of the City of Bondurant, Iowa, 1996, by amending provisions pertaining to one way traffic within the corporate city limits of the City of Bondurant, Polk County, Iowa, as the third and final reading.  Roll Call: Bailey-Yes, Cordes-Yes, Valentine-Yes, Thomas-Yes, Williams-Yes.  Motion carried.

 

Motion made by Council Member Valentine, seconded by Council Member Bailey, to adjourn said meeting at 9:40 p.m.  Roll call: Ayes: 5.  Nays: 0.  Motion carried.
