Meeting No. 01-06
A regular meeting of the City Council of the City of
Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant
City Center on the 19th day of March, 2001, at 7:00 p.m.

Notice of the meeting was posted at the Bondurant City Center, Ampride Store, Casey’s General Store, and Farmers Savings Bank on March 16, 2001. All proceedings here after shown were taken while the convened meeting was open to the public.

Ihde called the meeting to order at 7:01 p.m.
Roll call was taken and a quorum was declared.
Motion made by Council Member Valentine, seconded by Council Member Cordes, to approve the agenda as presented. Roll Call: Valentine-Yes, Cordes-Yes, Thomas-Yes, Williams-Yes. Motion carried.
Motion made by Council Member Thomas, seconded by Council Member Valentine, to approve the consent items consisting of the City Council Minutes of March 05, 2001, Council Roundtable Minutes of February 21, 2001, Metropolitan Advisory Council Minutes of March 07, 2001, Des Moines Area MPO Minutes of February 15, 2001, Polk County Aviation Authority Minutes of February 08, 2001, the Claims and Financial Reports, and Tax Abatement Application for Keith Williamson, 1420 – 2nd Street, Northeast, Bondurant, Polk County, Iowa. Roll Call: Thomas-Yes, Valentine-Yes, Cordes-Yes, Williams-Yes. Motion carried.
Council Member Bailey arrived at 7:05 p.m.
Polk County Sheriff’s Department Lt. Jorgenson had nothing to report.
Motion made by Council Member Williams, seconded by Council Member Cordes, to approve Resolution No. 01-27, a Resolution establishing a Public Hearing date of April 02, 2001 for the City of Bondurant FY 2001 / 2002 Budget. Roll Call: Williams-Yes, Cordes-Yes, Valentine-Yes, Thomas-Yes, Bailey- Yes. Motion carried.
Discussion regarding the assessment for the 1st, 2nd, 3rd, 4th, and Railroad Streets, Southeast

Reconstruction Project included:
Council Member Williams asked for additional information regarding the assessment options, cost of engineering fees, attorney fees, and confirmation that delays will occur if objections to assessment are addressed.
City Administrator Carlyle gave an overview of the assessment options, the resident payment plan, project delays until Spring 2002 because of assessment requirements, delaying project might mean higher bids, and other cities no longer assess residents for street maintenance needs.
Mayor Ihde addressed the definition of the modified TIF area for the street improvement project, the experience gained and lessons learned from previous street improvement projects, Public Hearing costs, future sidewalk needs, street material and expectancy, road maintenance costs if project delayed, and importance of completing entire project including 1st Street Southeast and Railroad Street Southeast.
Bondurant resident Mrs. Pat Haning commented that property owners should be assessed for street projects, previous street projects were financed with assessments, TIF money could then be used for other city projects, length of time city can continue paying for all projects, and other cities’ policies on assessment.
Council Member Cordes questioned the assessment based on type of street, difference between a main road and residential street, need for assessment guidelines for future projects, city responsible for maintenance of paved streets, and the amount of assessment versus the costs involved to assess.
Council Member Bailey questioned the penalties for the few to be assessed, many residents will benefit from the improvements, the project has already been bonded for reimbursement, and project costs will increase due to delays.
Bondurant resident Mrs. Mary Newell commented that everyone should pay for assessment, increased traffic on Lincoln Street Southeast, and not fair to all residents without assessments.
Bondurant resident Mr. Jack Newell commented on the criteria used for the formula to determine the assessed value of the residence.
Council Member Valentine commented that income should not play part in determining assessment, assessment process will cause more expense for city, and residents will not appreciate assessment.
Council Member Thomas commented on previous street projects should have been assessed, guidelines to assess for future projects should be determined, and 2nd, 3rd, and 4th Streets Southeast have not been paved, and previous residents were assessed for their streets to be paved.
Stanley Consultants, Inc. Representative Michael D. Flattery, P.E., commented an assessment policy must be defined, assessment formula can include frontage and/or depth, type of surface, values of properties will increase, and assessments must have the full support of council members.
Motion made by Council Member Thomas, seconded by Council Member Cordes, to approve Resolution No. 01-28, a Resolution approving the assessment formal for the 2001-1st, 2nd, 3rd, 4th, and Railroad Streets, Southeast Reconstruction Project, inclusive of the sidewalk assessments. Roll Call: Thomas-Yes, Cordes-No, Valentine-No, Bailey-No, Williams-No. Motion failed.
No action taken on Resolution No. 01-29.
Motion made by Council Member Bailey, seconded by Council Member Valentine, to approve Resolution No. 01-30, a Resolution providing for a Notice of Hearing on Proposed Plans,

Specifications, Form of Contract and Estimate of Cost for the 2001 – 1st, 2nd 3rd, 4th, and Railroad Streets, Southeast Reconstruction Project, and the taking of bids thereafter. Roll Call: Bailey-Yes, Valentine-Yes, Cordes-Yes, Thomas-No, Williams-Yes. Motion carried.
Stanley Consultants, Inc. Representative Michael D. Flattery, P.E., gave the council members an opportunity to review any questions relating to the 2001 Sanitary Sewer Improvements Around Anderson Elementary.
Motion made by Council Member Cordes, seconded by Council Member Williams, to approve Resolution No. 01-31, a Resolution providing for a Notice of Hearing on Proposed Plans, Specifications, Form of Contract and Estimate of Cost for the 2001-Sanitary Sewer Improvements Around Anderson Elementary Project, and the taking of bids thereafter. Roll Call: Cordes-Yes, Williams-Yes, Valentine-Yes, Thomas-Yes, Bailey-Yes. Motion carried.
Mayor Ihde gave an overview of the Metro Advisory Committee (MAC) and asked the Council to submit a priority list of items they would like to see the Committee accomplish. The Council asked for sharing of equipment, purchasing of products, regional wastewater treatment plant, and human resources. Council members are encouraged to submit any ideas to the Mayor or Council Member Cordes before the next MAC meeting.
Motion made by Council Member Cordes, seconded by Council Member Bailey, to approve Resolution No. 01-32, a Resolution approving a contribution to the Metro Advisory Committee, in the amount of $50.00. Roll Call: Cordes-Yes, Bailey-Yes, Valentine-Yes, Thomas-Yes, Williams-Yes. Motion carried.
Motion made by Council Member Williams, seconded by Council Member Bailey, to approve Resolution No. 01-33, a Resolution approving the appointments of City Administrator Carlyle as Primary and Council Member Thomas as Alternate to the Wastewater Reclamation Authority. Roll Call: Williams-Yes, Bailey-Yes, Valentine-Yes, Cordes-Yes, Thomas-Yes. Motion carried.

Fire Chief Brian Poffenberger gave an overview of the fire on March 18, 2001. The City of Bondurant Fire Department was assisted by the fire departments from Altoona and Ankeny. There were two fires at the residence and both fires are being investigated by the Fire Marshall, Polk County Sheriff’s Office, and the City of Bondurant Fire Department.

Ø Highlighted letter to Metropolitan Planning Organization from the City of Bondurant and the City of Polk City, asking for full participation with voting rights in the organization.
Ø Highlighted conversation with the Cable Company regarding cable service to the City Center.
Ø Highlighted IDOT Public Hearing regarding the service road plans for Northeast 64th Street.

Ø Gave an overview of the meeting with Representative Geri Huser and Senator Jeff Lamberti regarding the current Legislative Session.

discussed as part of City Administrator Carlyle’s comments:
v Referenced the official count from the U.S. Census for the
population of the City of Bondurant.
v Highlighted acceptance policy with the Metro Waste Authority
regarding appliances and the impact on clean-up day in October, 2001.
v Highlighted communication from the Iowa Department of
Transportation regarding the intersection of U.S. Highway 65 and Iowa Highway
945 (Grant Street, South). The IDOT has
hired a private consultant to evaluate a broader time span and reflect a truer
use of the road.
v Announced the recodification process is in the final stages
and the Council will review in April.
