NOTICE IS HEREBY GIVEN that a Regular Meeting of the City Council will be held at 7:00 p.m. on Monday, September 07, 2000, in the Bondurant City Center at 200 Second Street, Northeast, Bondurant, Polk County, Iowa.  Said meeting is open and the public is encouraged to attend.

A regular meeting of the City Council of the City of Bondurant, Polk County, Iowa, was held in the Community Room at the Bondurant City Center on the 07th day of September, 2000, at 7:00 p.m.

Notice of the meeting was posted at the Bondurant City Center, Break Pointe Store, Casey’s General Store, and Farmers Savings Bank on September 06, 2000.  All proceedings here after shown were taken while the convened meeting was open to the public.

 

Mayor Ihde called the meeting to order at 7:00 p.m.  Roll call was taken and a quorum was declared. 

 

Motion made by Council Member Cordes, seconded by Council Member Bailey, to approve the agenda as presented.  Roll call: Cordes-Yes, Bailey-Yes, Valentine-Yes, Thomas-Yes.  Motion carried.

 

Guest present resident Jonathan Balashaitis, 900 Filmore Avenue Southeast, asked for clarification regarding the nuisance ordinances.  City Administrator Carlyle stated the steps that are taken after a complaint is received at the City Center. 

 

Motion made by Council Member Thomas, seconded by Council Member Bailey, to approve the consent Items consisting of the City Council Minutes of August 21, 2000; Planning and Zoning Commission Minutes of August 10, 2000; Park and Recreation Board Minutes of April 27, 2000; Polk County Aviation Authority Minutes of August 10, 2000; Keep Central Iowa Beautiful Meeting Notes of August 17, 2000; and the Claims Report.  Roll Call: Thomas-Yes,  Bailey-Yes, Valentine-Yes, Cordes-Yes. Motion carried.

 

Polk County Sheriff’s Department representative gave an overview of the activity in Bondurant for the past two weeks.  

 

Jay N. Rosenberger Property Representatives Ed Skinner and Stephen P. Rowe presented the council with an overview of the Site Plan for the Jay N. Rosenberger Property.  The overview included:  the description of the detention pond, 7 1/2 acres, fifteen feet deep, storm water retention facility, follows Des Moines standards, incentive for industrial growth,  jointly owned and maintained by Ziegler and the Rosenbergers, and liability issues will be the responsibility of the owner.

Motion made by Council Member Cordes, seconded by Council Member Bailey, to approve Resolution 00-69, a Resolution approving the Site Plan for the Jay N. Rosenberger Property, as presented and recommended by the Planning and Zoning Commission.  Roll Call: Cordes-Yes, Bailey-Yes, Valentine-Yes, Thomas-Yes.  Motion carried.  

 

A & M Properties Representatives Eric Gjersvik, P.E., Michael R. Adams, and Nate Miller presented the Council with an overview of the Site Plan for the Mulberry Pointe Apartments.  The overview included:  plans for seven buildings with nine units per building, 126 parking stalls, eleven garage buildings, parking on the east side away from the residential area, landscaping, detention basin to the south, development will begin at Washington Avenue, SE, and completion of the project within three years.

 

Resident Larry Dewey, 601 Brick Street, Southeast, expressed these opinions: small area for number of residents, considerations for utility easements, grading should be done up front, and property values.  Resident Steve and Tamara Schopf, 705 Brick Street, Southeast, expressed these opinions:  two story dwelling within sixty feet of homeowners, small space for number of residents, asking for privacy fence rather than trees, one entrance rather than two, landscaping should be done now, amount of time to evict someone, more public awareness, and tornado shelter. 

 

Resident Lori Fry, 701 Brick Street, Southeast, expressed these opinions:  two story dwellings behind ranch style homes, crime, drugs, small children, residents involved in community, privacy fence, and one entrance.  Resident Tim Baker, 605 Brick Street, Southeast, expressed these opinions:  time frame for grading, apartments are trouble, kids playing in yards of nearby residents, seniors will not climb stairs, and financing.  Resident Mike Kossack, 809 Jefferson Avenue, Southeast, expressed these opinions:  homeowners have a long term future in city, pay taxes, and other developers may not build homes due to apartment complex.

 

Resident John Connett, 609 Brick Street, Southeast, expressed these opinions:  does not want violence, thefts, and drugs, and mortgage twice the price of apartments.  Resident Barry Roth, 100 – 3rd Street, Southeast, expressed these opinions:  town growing, violence, keep community small, and tax abatement problems. Fire Chief Jeff Kromrie expressed these opinions: paramedics want an apartment in Bondurant, good schools, not everyone can start out in home, and no control over neighbors buying homes.

 

Mayor Ihde wanted the residents to know City of Bondurant is currently negotiating more time for the Polk County Sheriff coverage, fire and rescue will require two entrances rather than one.  A & M Properties Representative Nate Miller is willing to work with community regarding concerns.  City Administrator Carlyle explained the residential and commercial tax abatement available in Bondurant.  Don Coates, Eastern Polk Regional Development, expressed the need for community support for the project.

 

Motion made by Council Member Thomas, seconded by Council Member Bailey, to approve Resolution 00-70, a Resolution approving the Site Plan for the Mulberry Pointe Apartments, as presented and recommended by the Planning and Zoning Commission. Roll Call: Thomas-Yes, Bailey-Yes, Valentine-Yes, Cordes-Yes.  Motion carried.

Motion made by Council Member Bailey, seconded by Council Member Cordes, to approve Resolution 00-71, a Resolution approving a Memorandum of Agreement between the City of Bondurant, Polk County, Iowa and Polk County, Iowa, relating to a seal coat project on Northeast 62nd Avenue.  Roll Call:  Bailey-Yes, Cordes-Yes, Valentine-Yes, Thomas-Yes.  Motion carried.

 

Motion made by Council Member Cordes, seconded by Council Member Bailey, to approve Resolution 00-72, a Resolution approving to fix a date for a public hearing on a loan and disbursement agreement for the Water Main Improvements Project – Connection to DMWW Water Main.  Roll Call: Cordes-Yes, Bailey-Yes, Valentine-Yes, Cordes-Yes.  Motion carried.

 

Motion made by Council Member Bailey, seconded by Council Member Thomas, to approve Resolution 00-73, a Resolution declaring “Beggars Night” within the City of Bondurant , Polk County, Iowa on Monday, October 30, 2000 between the hours of 6:00 – 8:00 p.m..  Roll Call: Bailey-Yes, Thomas-Yes, Valentine-Yes, Cordes-Yes.  Motion carried.
